Tyler Bensch, who used bear spray during the Capitol attack, was sentenced to probation and 60 days home detention instead of the nine months in prison sought by prosecutors. “I am giving you this break because of your age” at the time and a lack of criminal history, McFadden said.

Bensch was arrested in August alongside members of the "B Squad"who were associated with the far-right Three Percent movement and "Guardians of Freedom," as well as Jeremy Liggett, a far-right extremist who ran unsuccessfully for a congressional House seat last year.

Bensch pleaded guilty to disorderly and disruptive conduct on restricted grounds along with theft of government property, admitting that he helped carry a stolen police shield from the grounds of the Capitol. In an interview with the FBI after his arrest, Bensch said B-Squad members took part in firearms training and hand-to-hand combat training ahead of the attack.

I am all for leniency when there is remorse. He pleaded guilty. He is young. We have suspended sentences in the UK which allow people to demonstrate their good character on pain of going to prison for the original offence if they break their terms of probation.

Maybe that arrangement would be suitable. Teenagers make mistakes and they need not be labelled for the rest of their lives for them.

Many people would think he got off lightly. Maybe.

Judas acquitted!

Beeks waived his right to a jury trial, opting instead to represent himself and be tried by Judge Amit Mehta.

According to court records, Mehta acquitted Beeks on two charges, claiming the U.S. Department of Justice failed to prove that Beeks knew there was a conspiracy.

Prosecutors agreed to drop the four remaining charges.

Donovan Crowl, part of a line that marched into the Capitol, was convicted of conspiracy.​

Donovan Ray Crowl, one of the first rioters to be identified in national news media as part of a line of Oath Keepers who marched single-file in combat-style gear on the Capitol steps on Jan. 6, 2021, was convicted Wednesday by a federal judge of conspiracy to obstruct the electoral college vote count and civil disorder.

Crowl is the latest of more than 20 Oath Keepers members and associates to plead guilty or be convicted of crimes in the attack on the Capitol. Oath Keepers founder and leader Stewart Rhodes and 12 others were found guilty of felony charges in three separate jury trials, but Crowl and [the acquitted] Beeks [who joined the squad that morning and hadn't been involved in planning] took a different route: a stipulated bench trial, in which the facts were agreed upon by both sides and submitted to Mehta, who then issued verdicts without hearing from witnesses or either defendant.

A Florida Proud Boys member who was recorded yelling “Let’s take the [doggone] Capitol!” before rioting began and who led a charge that broke through a key police line on Jan. 6, 2021, was sentenced Wednesday to five years in prison.

Scott was admonished earlier that day by Proud Boys leaders to not yell on camera about the group’s plans or intentions as they circled the Capitol

Justice Department appeals Jan. 6 prison sentences for Stewart Rhodes, Oath Keepers

U.S. District Court Judge Amit Mehta sentenced Rhodes to 18 years in prison — the harshest sentence for any Jan. 6 defendant — reflecting his leadership of what Mehta characterized as a dangerous criminal conspiracy aimed at violently derailing the transfer of presidential power.
Nevertheless, the sentence for the Yale Law School graduate and disbarred attorney was seven years shorter than the 25-year prison term prosecutors recommended and four years below an agreed-upon “guidelines range” based upon Rhodes’ conduct.

[Other seditious conspirators:]
  • Florida Oath Keeper leader Kelly Meggs received a 12-year term; DOJ sought 21 years.
  • Roberto Minuta of New York was sentenced to 4.5 years; DOJ sought 17 years.
  • Joseph Hackett of Florida received a 3.5-year sentence; DOJ sought 12 years.
  • Ed Vallejo of Arizona received a 3-year sentence; DOJ sought 17 years.
  • David Moerschel of Florida was sentenced to three years: DOJ sought 10 years.
DOJ also appealed the conviction of two Oath Keepers acquitted of seditious conspiracy but convicted of conspiring to obstruct Congress:
  • Jessica Watkins of Ohio, who was sentenced to 8.5 years in jail; DOJ sought 18 years.
  • Kenneth Harrelson of Florida, who was sentenced to 4 years; DOJ sought 15.

FBI, DHS Failed to Take Jan. 6 Threats Seriously, Senate Report Says


Federal agencies received intelligence about the possibility of an attack on the Capitol​

The report shows that the FBI and DHS’ Office of Intelligence and Analysis (I&A) collected tips and intelligence that threatened or predicted the kind of violence that occurred on Jan. 6. This included plans to come to Washington, D.C. armed, threats against politicians and opposing protesters, and sharing of maps of the Capitol’s tunnel system.

Some of this information had been previously reported, but Erik Dahl, an associate professor of national security affairs at the Naval Postgraduate School who has written extensively about the specific intelligence failures in the lead up to 9/11, told Just Security in an email that while reading the report he was surprised by “the sheer volume of warnings that were in the system before January 6.”

The '█████ Shaman' and other Capitol rioters who regret pleading guilty


"I am truly, truly repentant for my actions, because repentance is not just saying you're sorry," he said [at his sentencing after a guilty plea]. "Repentance is apologising and then moving in the exact opposite direction of the sin that you committed.

A judge called his apology "the most remarkable I've heard in 34 years" and sentenced him to 41 months in prison - considerably less than the maximum allowed.

Now more than a year-and-a-half later, Angeli is out of jail early, and his remorse is gone.

His about-face is such that he is even taking his case back to court to ask his guilty plea to be reversed. And he is far from the alone in changing his mind about the events at the Capitol.

Facing 30 days in prison and three years of probation, Athanasios Zoyganeles pleaded guilty last year to illegally demonstrating in the Capitol.
But like Angeli, he has since changed his mind. He told a reporter this month that he didn't do anything wrong and had been persuaded into an admission.

His lawyer has since asked to delay sentencing.

John P Gross, a criminal law expert at the University of Wisconsin, said that having a change of heart can carry legal risks.
The concept of "trial penalty" means that in general, defendants who plead guilty receive lighter sentences than those convicted after a trial. Judges also have leeway to impose harsher sentences if they believe defendants aren't truly sorry.

Apparently they got married sometime between the Capitol and her arrest in May.

He got caught up in a few important phases of the attack. He apparently pushed on the fencing at the second walkway barrier and then was on the line facing off against the police at the bottom of the Capitol steps. Finally he shows up at the back of the crowd around the tunnel attack. For this he got a civil disorder felony charge.
