So?
They are still the law.

And it was the law of the Soviet Union to arrest, and send to Siberia, anybody who attended any Church, except for clergymen who were controlled by the government.

And I can't comprehend anybody who could hold such a simplistic understanding of Natural Law theory that any, passed by the legislature (or executive) of any government, is always morally acceptable and does what it's supposed to accomplish.

If you truly believe that (which I know you don't, but that's what is suggested by your argument), then you have no right to complain about Trump's immigration policy.

Then go to Iowa and lobby the legislature to change the third strike law. The people elected their representatives who enacted the laws. If you have no dog in the fight it's none of your business.

That's not how democracy works, my dude. The majority is not this "infallible voice" that's immune from criticism, and anybody whose dissenting should be censored. I'm allowed to criticize the Third Strike laws all I want, per the 1st Amendment.

Also, Hitler was elected by the people. Just saying. So I guess we aren't allowed to criticize Hitler or his policy, because he was just executing the will of the German people.

In America specifically, are we not allowed to criticize Prohibition, because it was an amendment passed as the vox populi?

It's horrifying that people have thought processes like you, horrifying for the future of our country.

Another thing, it definitely is applicable, because not all laws are the de-facto voice of God. That's not at all how even Natural Law Theory works, per the Apocalypse of Saint John. That was the point of the Soviet Union reference. Do you not understand "analogization" as a logical argument?

Seems a little more to this then burning the flag. Not his Church.. so to rip it down and burn it.. like coming to your house taking your "any flag" and burn it. That in its self is a crime. All in all I don't see how 15y is ok!

We see "Christians" will HAVE to make a choice of where you stand :) Gay is a sin. But what he did was wrong. He could have walked in there and asked to talk to the Preacher and chat.. debate, pray with.

Evidently, you didn't take government in school because that is exactly how it works.
I'm allowed to criticize the Third Strike laws all I want, per the 1st Amendment.
Unless you do something illegal while protesting, then you may wind up snacking up with the flag burner.
Also, Hitler was elected by the people.
No he wasn't. He was appointed to his position as Chancellor of Germany.
Just saying. So I guess we aren't allowed to criticize Hitler or his policy, because he was just executing the will of the German people.

This is a massive moral conundrum. On one hand, this is a hateful act- regardless of what you think of the LGBT community, and the guy is a massive jerk obviously. However, if American flag burning falls under free speech, then burning other flags does too. Do we hold the LGBT flag to a higher standard than the American flag? Because that’s not the america I want to live in.

What, is the guy going to be deterred from being "bigoted" any more? Is the guy going to stop being a criminal?
He won't be out to commit crimes for a good while ...
I'm reminded of U.S. v. Holloway, where a guy was sentenced to 57 years in prison for three carjackings.
Do you think that was extreme ???

Still. Just replace one item in that story. Make it an American flag. If you do and don’t change a single solitary item, especially what he said. Now all of a sudden he is a hero to a 1/3 of the country. A cause celeb.
Very doubtful. The vast majority of Americans respect the flag. There may be one half of one percent that would applaud him but not many. The only thing that would be different is the hate crime disappears but the arson charge and third strike still remain.

I'm so sick to death of the gay agenda I would probably burn their flag too!
If you'd like, as long as you didn't rip it off from someone else and drive to a strip club and set it on fire I don't think there'd be a problem.

And God would probably give me a God star!
...or not.
tulc(suspects getting a "God star" isn't really about burning things) :sorry:

WAY over reacting! Fined or time for trespassing, destruction of private property... but the burning of a flag is already established as free speech. To call THIS a hate crime and not call the burning of a US flag a hate crime is inconsistent.
At some point? People are really going to have to stop claiming he's going to jail "for simply burning a gay flag" he's going to jail because:
...we learned from the trial Mr. Martinez had been watching our church for some time."

"I believe him to be very dangerous," Story County Attorney Jessica Reynolds said. "That's why my office recommended the maximum sentence."

Reynolds said the judge agreed to the 17-year sentence because Martinez has a long history of harassment and is a habitual offender and never showed any remorse.

"The defendant stated that there was nothing the judge could to stop him from continuing this behavior and that he would continue to do this no matter what," she said.

"It was an honor to (burn the flag)," Martinez told KCCI in June." It's a blessing from the Lord."
tulc(knows it makes sounds him sound more..."martyr", but it's simply not true)

Spoken as one clearly who has no idea of what occurred in this incident. Typical right winger.

He wouldn't have got this sentence for burning an American flag, nor would anybody, because no court would charge anybody with a hate crime for that.

And he didn't get the 15 year sentence for burning the rainbow flag. Go out and buy a rainbow flag and burn it in a place designated for burning and no one can do anything to you.
