  • CF has always been a site that welcomes people from different backgrounds and beliefs to participate in discussion and even debate. That is the nature of its ministry. In view of recent events emotions are running very high. We need to remind people of some basic principles in debating on this site. We need to be civil when we express differences in opinion. No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

Was the Prosecution of Dinesh D'Souza a case of Political Targetting

When researching into this topic due to another post, I found some interesting analysis.
Even if allegations made against conservative filmmaker Dinesh D'Souza in a federal indictment on campaign finance violations prove to be true, legal experts and former federal regulatory authorities tell Newsmax that the government's handling of the case has been unusual.

"This is clearly a case of selective prosecution for one of the most common things done during elections, which is to get people to raise money for you," famed law professor Alan Dershowitz told Newsmax.

It should also be noted that the prosecutor (U.S. Attorney Preet Bharara), has been involved in at least 2 cases (which may also have been politically motivated) where the convictions were ultimately overturned on appeal.

There are two ways to tell. One is to compare how similar acts have been handled. Far more egregious cases have generally been handled by the FEC. Even Barack Obama's campaign had far more serious violations handled by fines dealt out by the FEC. The second way to tell is to compare how other actors in the same case were handled. There were three actors in this case and I can only find one who was charged with any crime, D'Souza

Note to conservatives: D'Souza pleaded guilty. Gonna be tough to appeal the plea deal one accepts. When one commits a crime, the "everybody does it" defense is weaker than any defense with the possible exception of pleading insanity. If he had any defense at all, he needed to go to trial. And he's got the ability to raise a defense fund (assuming conservatives are willing to put money behind mouth). Then he could appeal the verdict if convicted.

The only way to appeal a plea deal would be the appearance of new evidence.

Have a nice stay, D'Souza. You'll have time to write another book. maybe about how corrupt the campaign finance system has become. Or, how to do stupid and still make money.

Which all misses the point. D'Souza has no intention of filing an appeal and claimed no defense. He pled guilty because he did what he was charged with doing. The question is was it a political prosecution from the beginning.

It's campaign law. Campaign law is political by definition.

But prosecutions are not supposed to be

Good luck with that. I've got a suggestion for the title of the book he'll write in prison:

Is it racist to arrest a black man for committing a crime (that he actually committed)?

Was it politically motivated? Could be. But the fact is, the guy broke the law and did it in a way that was actually pretty stupid. The guy is a big target. If you are going to put a Bulls Eye on your back, its not too bright to be the one using it for target practice.

Actually if the prosecution was solely due to political reasons (that he's been criticizing the parties in power), while the cronies of the party in power gets a pass, then it is grounds for the conviction to be overturned on the basis of enforcement of the statute is being conducted in an unconstitutional manner.

As Republicans are want to point out (pg 19), targeting people for political reasons is not unconstitutional.

Ummmmmm, no. He committed a crime, he plead guilty to it, not grounds to overturn it.

Pretty amazing the lengths some will go to to defend an admitted criminal. I would expect nothing less from the party of personal responsibility.

Clinton was an admitted criminal and there was no shortage of defense for him.

The point isn't whether or not he is guilty, he is. The point is whether or not he was treated differently than others because of politics

Y'all are such a fun fest. Clinton being targeted for his politics did not change the fact that he was guilty and faced the consequences. In fact he and D'Sooza seem to have similar commitments to family values.^_^

He isn't going to prison

So even less reason for all the whining on his behalf. Guess he can switch book emphasis to something like, Meine Ehe.^_^
