XBox Live Question

I'm thinking about getting XBox live, but I'm wondering one thing...

If I have XBox live on an XBox, can both my brother/friend and I log on with a split screen and play on the same server with the same XBox?

If it varies from game-to-game, what games can you do it with? I'm more concerned about Halo 2, but I doubt I'd get an answer for that game as it isn't out yet.
