Cases like these are probably a huge reason that many companies and corporations have to have such high prices, in order to cover liability and insurance.

Seriously, it's sad.

so now, our coffee cups from McDonalds have to say "Caution: hot!"

but it makes me laugh even more because it doesn't say "may be hot" it just says it IS hot... and if it sits there for 12 hours, it's obviously not going to still be hot...

the thoughts of someone who should be sleeping at 1 am...

Back in the day, an engineer for Ford asked the President of the company to install safety glass in the windshields like General Motors was doing so that when there was an accident the people in the car would not have shards of glass impaling them. The answer was that Ford was in the auto business and not in the safety business.

That mentality led to Ford being the first company in history to have the first million dollar judgement against them in a civil case over the Ford Pinto when a bunch of teenagers were burned alive in an accident.

Remember when Gerbers watered down baby food ? When Nutrasweet was connected to miscarriages ?

Civil litigation is a safety net.

As you do have a good point...

Glass and watered down food and nutrasweet is not the same thing as

Caution: Contains may be hot.

They do not.
They have not been warned.
They are not liable. I suggest you talk to anyone in the industry about brewing and holding temps. They will set you straight.

Sorry, you're wrong. McDonald's coffee is hotter than typical, it isa SEVERE third degree burn risk at 190 degrees and not fit for consumption at that temperature, and they HAD been warned of the danger. How did you get so certain that you were correct when you were oh so terribly wrong?

Talk to anyone that's actually in the restaurant coffee industry, not some website that happens to support your opinion. I am not terribly wrong. I am accurate. McDonald's coffee is STILL brewed at 185-195, which is the industry norm, and held at 180 for 30-60 minutes. It's quite fit for human consumption. In fact McDonal'ds beat out a bunch of Starbuck's type places for taste and freshness recently.

I'm wondering if the issue is more that the cost of health care are rising and becoming less affordable for people who then see no other recourse but to sue to get the money to pay for their medical bills??

That's exactly what I mean, it would be a virtuous act to do so. So why not do so?
I don't get this. You don't think they were obligated to pay her bills, but since it would be virtuous for them to do it then they should get sued if they don't??

Have you been smoking something?

If you are injured, you have the right to sue if you feel that the other party is even partially responsible.

That might be the root of the McDonalds case. An attempt to get a partial payment for enormous medical expenses. McDonalds just got the wrong jury and paid a bundle.

If you get hurt, your insurance company might force you to sue or lump the bill on your own. That is the system. I don't think that anyone believes that if some klutz or burglar falls in your house through their own negligence that your homeowners ins. should be responsible. But that is just the way it is.

It's sad that, that happened to her but, than again...coffee is hot! It just is. You can't get coffee and expect it to be lukewarm. I don't think she deserved to be ridiculed, but I never heard of that happening. You can't just blame people for your own doing. Thats just as bad as the one incident with the man and the crane machine. He won a toy and it was stuck and he shook it and shook it over and over...eventually it fell on top of him and he sued the company and won. People shouldn't be rewarded for there own stupidity.
