The Brief
  • Trump’s lawyers seek to dismiss his conviction, citing his election win and Hunter Biden’s pardon.
  • Judge Merchan delayed sentencing, considering postponement until after Trump’s term.
  • Prosecutors defend the conviction and will respond by Dec. 9.

Joe Biden's declaration that his son Hunter's conviction was the result of political tactics, gives credence to the claim that such is occurring within the judicial system. I think Biden may have given Trump an early Christmas present.

Yeah, because up until now Trump was consistently and loudly telling everyone that the justice system was perfectly fine. It was only the Biden pardon that made him change his mind.

Come on, be serious. Trump's story for nearly a decade is that any legal troubles he finds himself in is clearly someone else's fault. This is just more of the same, a guy who can't take responsibility for his mistakes. Don't fall for it, again.

While I have my issues with the pardon situation currently going on...

What details or political angle are they using to suggest that one has anything to do with the other?

If he was convicted of something
"Yeah, but I won the election"
and
"Yeah, but Biden pardoned his son"

...don't, at first glance, seem to have anything to do with Trump's situation.

As far as I can tell, the Trump conviction and the Hunter Biden pardon are two completely detached events.

Basically Biden pardoning his son and potentially pardoning, others not yet convicted of a crime; is basically a carte blanche for anything Trump decides to do. Maybe not morally or legally, but politically it's the ultimate "whataboutism".

It's why Biden says he pardoned Hunter. Trump has been saying all along that his conviction was the result of a political attack regarding the presidency through the judicial system. Biden said he pardoned Hunter because his conviction was the result of a political attack regarding the presidency through the judicial system.

In other words Biden established that's something that really happens. Effectively corroborating Trump's plea. From now on anytime someone says "that's impossible" or "that's just a conspiracy theory", the rebuttal can be "not according to President Joe Biden ho issued a pardon based on it".

It says that according to the POTUS, not only does it happen, it's grounds for a pardon. That's the precedent Biden just established. He gave the court the opportunity to dismiss the charges against Trump and to use Biden's statements and actions as the precedent for doing so.

It certainly seems back up the SCOTUS ruling regarding presidential immunity. Which also cover's Joe Biden if the the Republicans wanted to charge him with a crime once he's left office. People seem to ignore the fact that the ruling also protects Biden after he leaves office.

No, it's that Biden essentially corroborated Trump's plea as being legitimate and furthermore qualifies him for a pardon/dismissal based on that.

If the SCOTUS wants to dismiss Trump's conviction, Biden just gave his decision and action based on that decision, grounds for doing so. That compounded with Juan Merchan's decision to not carry out sentencing.

Biden is expressing one persons opinion. I dont see how that could pass as evidence for a court to consider.

Up until recently it was pretty much just Trump and Republicans saying the justice system had been politically weaponized. And the Dems saying if the SCOTUS dismissed Trump's conviction it would show that Trump had the majority of them in his pocket.

But that's all changed now. President Biden carried out an executive order on the grounds that the justice system had been politically weaponized. So now when the SCOTUS dismisses Trump's conviction, they'll just be doing a Biden.

Also Democrats can't really stick with political weaponization of the justice system is a lie and a conspiracy theory, because their own President says otherwise based on his executive order.

Trump: "My conviction is unlawful because the justice system has been politically weaponized, therefore my conviction merits a dismissal".

Biden: "My son's conviction is unlawful because the justice system has been politically weaponized, therefore my son's conviction merits a pardon".

Not "on the grounds". He needs no grounds according to current understating of the pardon power. His opinion is just for the sake of public impression and carries no legal weight.

D's are appealing to statements from Trump and his FBI candidate about how they will use the justice system. The presidents pardon rationale is future orientated and makes no claim about any past "weaponization". (This is regardless of whether theres anything actually substantive to those statements).

Biden has no right to point fingers at Trump, because if he did, that would be incredibly hypocritical.

Tsk tsk tsk

By agreeing with Trump that the justice system has been politically weaponized and issuing an executive order based on that.

Not true. The Biden claim is that there are plans to politically weaponize the justice system. True or false, he makes no claim that the justice system has already been weaponized.

I dont understand this incapacity to distinguish past from future.

So do you think there's absolutely no possibility whatsoever that the SCOTUS could use Biden's accusation in part as grounds for dismissing Trump's conviction?

Not true. Biden said he pardoned Hunter because his conviction occurred because the justice system had been politically weaponized (past tense) against him.

0.0% possibility.

1. Biden's statement says nothing about the past.

2. Biden's statement is sheer opinion.

I mean, I kinda do think that in NY anyway, Trump did come under selective scrutiny resulting in a sketchy case (for which he was 100% guilty, in my sheer opinion, but was not afforded the proper legal rights up front.) But even so, Biden is saying neither that he agrees with me nor that the Hunter pardon relies on past weaponization for a rationale.
