So Herod, having survived the slaughter of his son [Antipater] five days, died, having reigned thirty-four years, since he had caused Antigonus to be slain, and obtained his kingdom; but thirty-seven years since he had been made king by the Romans [

According to Wikipedia anyway, Herods kingdom was from 37 BC to 4 BC, and Josephus dates his death 34 years after OBTAINING the kingdom and SLAYING Antoginus.
So it is very logical that his death was in 1 BC, and that between the time the Romans appointed him king, and when he took the throne in-fact was about 3+ years. Therefore his son ruled during the 4 BC to 1 BC while Herod lived is the appropriate explanation, and Josephus indicates his son did have authority while Herod lived.
So if the date Herod was legal king was 37 BCE per the romans, then Josephus counts his death at 1 BC.
I guess the calendar is right after all!
