The Perfect Path for Pence (or whoever presides)

What will Pence or the presiding Senator do...

  • 1) Rubber stamp the Biden electors making Biden president

    Votes: 6 85.7%
  • 2) Kick things back to the State Legislators

    Votes: 0 0.0%
  • 3) Other... tell me whatever your option is

    Votes: 1 14.3%

  • Total voters
    7

Pence can kick things back to the states legislatures when they got two sets of delegates, and have them rule if their elections followed their Constitution and were trustworthy. This is according to the Constitution and a few historical precedents.

This is kind of the perfect middle of the road option that is legal, although controversial, but at least appeases the pro-Trump base of the party etc. even though it will infuriate the liberal end of the country.

Or will he do what our contemporary career politicians always do....

I think Pence will rubber stamp it.. that's just honest. The states certified and the electoral college voted.

He's not going to put that kind of pressure on the republican congressmen, some of whom are running again in 2 years... the party isn't risking losing in 2022, or 2024..

Other - he will do what the Constitution requires given every state has sent a single certified slate of electoral votes. That is not a "rubber stamp" giiven the negative connotations of that word. He doesn't actually approve anything for him to rubber stamp anyway.

So this suggest that Biden will be elected today, but what the process will take 4 times longer because of Philibusters....? (I say this as I am watching things on TV)

Any electoral college votes that are challenged by one senator and one representative will be heard and their evidence presented, and then the congress will argue the points and vote on any of the disputed electoral college votes.

It'll take a while...

The insurrection at the Capitol will delay things, but it won't change things. The big issue now, is that Trump's refusal to allow the transition to go forward, will cripple our ability to deal with any crisis at this time.

Our enemies are rejoicing.

They didn't get two slates of electors from any state.
