No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

Yeah, I don't see how they didn't charge him. While the dude made verbal statements that could be construed as threats he didn't actually attack anyone or make specific threats toward anyone as far as I am aware. Even if he did he was unarmed. It would have just been assault. Dude was obviously mentally ill, but you can't justify it, IMO

Also, some of the statements that have been made by "former marines" and other service people I've seen online justifying this have really dampened my hope for humanity.

Watching this one.

Yep, the guy cannot claim self defence, and the victim did not lift an arm against anyone else. If this is legal then anyone mentally is at risk of being killed for existing.

No they aren't. Black kid punched an elderly racist man awhile back in Florida....got pretty much a sweetheart deal. Assault plea, long probation, but no more jail than time served.

It really depends upon the circumstances.

Service members are not taught that choking a civilian to death is OK.

Id say likely mans slaughter will be charged as intent to kill (murder) would seem rather difficult to prove. We will just have to wait and see the outcome of it.

Its definitely not murder, and it is not a lynching. But manslaughter, negligent homicide are definitely on the table.

No. Sadly Jordan neely entered a train started shouting, but not being physically violent and was held down by the marine plus others and choke held to death.

Because whether or not someone can be considered an immediate threat is whether or not it's a reasonable conclusion based on the circumstances.

I've only bothered to listen to 1 eyewitness account from an elderly man who was there apparently. I haven't watched the video (I really don't want to) and if I'm not mistaken we can paraphrase what this man shouted like this....

"I'm hungry" "I'm not taking no for an answer" "I'll hurt anyone here" "I don't care what happens to me or if they put me in jail for life"

Now, they don't put anyone in jail for life for a mugging or simple robbery....typically not even for robbery with a deadly weapon.

They put people in jail for life for murder.

Now, given these statements are coming from an elderly man who doesn't seem to be involved in the fight that followed....I'm going to go off his words here even if they turn out to be unclear or unverifiable. If this is in the video....just say so.

While I have every sympathy for the homeless and hungry of New York who have endured the decimation of BLM riots on their police force, the covid lock downs and restrictions that killed small businesses and drove out wealthy taxpayers, the following and completely predictable rise in violent crime along with a much more passive (sometimes non-existent) police response, and the frustration of having to endure this while illegals are being bussed into the city to work all the kinds of jobs that the poor would normally take to survive.....

This man isn't begging for help he's threatening to kill or violently injure anyone who is either unwilling to be robbed or doesn't have anything to give him.

Before we move on to whether or not it's a reasonable assumption that he isn't just talking....he's actually a threat....would you describe the above characterization as fair?

I've been approached by beggars before....they don't shout "I'll hurt you" before demanding help.


Has anyone pointed out the irony of this situation compared to George Floyd's? Or perhaps, Eric Gardner? I'm gonna say something pretty wild here but....maybe....just maybe....all those outrageous situations where we endlessly scrutinized the police for handling poorly seemed to have obviously better ways to handle because we're analyzing them from the relative safety and comfort of our homes? Perhaps we would do no better than the police....or worse...should we find ourselves in these situations in real life? Just a thought.

I can't tell you how many times I heard about how the military never screws up the way the cops do....

I've always supported a more robust and widespread support for those suffering from mental illness....I'm not interested in speculation about whether or not this was a part of this particular incident. Mental illness doesn't absolve someone from being a criminal.

So what happened to start it off? Does everyone just jump on him while he's shouting? Or does he approach a passenger? Is he armed at all?? Maybe a roll of quarters in his fist?
