Part of the reason why he was hoping to avoid a prison sentence is because Hicks is a caregiver for his children.

LINDEN, Texas A Texas judge has given jail time to two of four men convicted of beating a mentally disabled black man and leaving him in a field. All four could have faced ten years in prison on the original charges in the 2003 beating of Billy Ray Johnson.
But citing the severity of Mr. Johnson's injuries and length of his recovery, the judge invoked his right to add short jail terms for the two who went to trial: 30 days for 20-year-old Christopher Colt Amox, who hit Mr. Johnson; and 60 days for 26-year-old James Cory Hicks, who assisted in hiding Mr. Johnson in a tire dump.
