I guess I'll start with the dictionary's defanition:

tes·ta·ment

that serves as tangible proof or evidence: The spacious plan of the city is a testament to the foresight of its founders.
  1. A statement of belief; a credo: my political testament.
  2. Law. A written document providing for the disposition of a person's property after death; a will.
  3. Testament Bible. Either of the two main divisions of the Bible.
  4. Archaic. A covenant between humans and God.

It makes you wonder why a legal document is titled,

Last Will AND Testament ? If they are both one and the same?

Does the word come from Testamony? Or Testify? Or do they come from that word testament?

This is the Greek word translated into testament

Diatheke

A feminine noun

Definition
  1. a disposition, arrangement, of any sort, which one wishes to be valid, the last disposition which one makes of his earthly possessions after his death, a testament or will
  2. a compact, a covenant, a testament
    1. God's covenant with Noah, etc.

But notice , there is no mention about blood in that definition above. A covanant always involves BLOOD. There is always the blood of the covenant.

Did they really have wills back in the 1st century?

Noun
(Law) A solemn, authentic instrument in writing, by which a person declares his will as to disposal of his estate and effects after his death.
Note: This is otherwise called a will, and sometimes a last will and testament. A testament, to be valid, must be made by a person of sound mind; and it must be executed and published in due form of law. A man, in certain cases, may make a valid will by word of mouth only. See {Nuncupative will}, under {Nuncupative}.
One of the two distinct revelations of God's purposes toward man; a covenant; also, one of the two general divisions of the canonical books of the sacred Scriptures, in which the covenants are respectively revealed; as, the Old Testament; the New Testament; -- often limited, in colloquial language, to the latter.
He is the mediator of the new testament . . . for the redemption of the transgressions that were under the first testament. --Heb. IX. 15.
