  • CF has always been a site that welcomes people from different backgrounds and beliefs to participate in discussion and even debate. That is the nature of its ministry. In view of recent events emotions are running very high. We need to remind people of some basic principles in debating on this site. We need to be civil when we express differences in opinion. No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

Surrogate wants to keep baby AND recieve child support

Whatever the outcome, I hope final custody is decided early in the child's life.

IMAO, I think the father should should have the choice between visitation/support or no contact if the custody is given to the surrogate mother.

I am thinking it will be a constant tug of war, using current problems to try to get the other out of the babies life.

The father can choose no contact, but he will always be the father and will have to provide support, just as if he had concieved the child by normal means.

The surrogate has no just foothold.
She cashed the check.
The pregnancy was not natural insemination.
Both sides agree that the plan was to give the baby to the real parents, not the surrogate.

For her to want to keep the child, and then demand money for it is another example of how bad western society has become. :(
From a contract law perspective I completely disagree. Verbal contracts have no weight when you are talking anything over $500. So her cashing that check means nothing. From a legal perspective that money could be viewed as father giving money to his baby-momma-to-be (to use the legal term;)).

Actually, IMO, the "parents" have little legal basis to get sole custody in this case. From a parental rights perspective the surrogate mother is the biological mother. Now if the father can show in court that his household is a better environment then he can get primary custody.
