Sen. Tommy Tuberville’s hold on military nominations means the Biden Administration won’t be able to permanently replace [the] top leader in the Marine Corps who is required by law to leave his post on Monday.

Commandant Gen. David Berger must step down Monday from his four-year tour, a term of service that cannot be extended unless the U.S. is at war or in the event of a national emergency.

Other top military positions are slated to become vacant soon and could be impacted if Tuberville’s continues his blockade of appointments.

Biden's choice will be in an acting/temporary role for the time being, but (as I understand it) this acting member of the Joint Chiefs of Staff has limited authority, since he has not been confirmed by the Senate. Other Joint Chiefs will also be termed out soon.

New Pentagon memo reshuffles workforce to offset Tuberville blockade

“This unprecedented, across-the-board hold is having a cascading effect, increasingly hindering the normal operations of this Department and undermining both our military readiness and our national security,” Austin writes in the Aug. 2 guidance, obtained by The Hill.

“In extraordinary cases,” lower-level officers in a grade of 0-8 or below who are not in the normal line of succession “may be assigned to head organizations in an acting capacity,” Austin writes.

Austin’s memo was issued ahead of the retirement of Army Chief of Staff Gen. James McConville, who vacated his role Friday without an official replacement.

Biden did allow Title 42 to continue, just like the Court said the Administration had to since it was due to expire anyways in ‘23; that has happened and “immigrant encounters” are down 70%.

If Biden is a traitor he’s a very bad at it.

WRONG. Stop acting like you know more about America than Americans. Title 42 actually exacerbated the influx. Since detained crossers were basically dumped at the border instead of being returned to their home county, they crossed again and again.

Since we got rid of Title 42, crossings are down 70%.

WRONG. Stop acting like you know more about America than Americans. Title 42 actually exacerbated the influx. Since detained crossers were basically dumped at the border instead of being returned to their home county, they crossed again and again.

Since we got rid of Title 42, crossings are down 70%.

He risks putting our country in jeopardy.
So the problem is that military promotions (particularly because there are a lot of them) tend to be passed by unanimous consent, which eliminates the need for time wasting debate. But a single person can prevent that. And I'm sure if they try to debate them the normal way Tuberville will filibuster. I'm pretty sure he won't be able to sustain them, but that will add more time to the process.

The Senate Rules and tradition allow one senator to hold up the works.

How can one senator do this alone?

In two words: unanimous consent. Among the mysteries of Senate procedure that mystify most Americans, perhaps none is more curious than the concept of unanimous consent.

As congressional scholars Casey Burgat and Charles Hunt put it in their 2023 textbook Congress Explained, "the Senate's rules grant incredibly powerful privileges to all Senators ... that greatly affect how and if the chamber schedules" floor action on any subject.

Mitch McConnell, the Republican from Kentucky who is the current GOP leader and the record-holder for longevity in that role once quipped that the Senate "requires unanimous consent to turn the lights on before noon."

The Senate majority leader could bring the nominations to the floor one by one for consideration by regular procedure, but that would require two to three days for each. [And the total number must be around 300 by now, so that's 2-3 years of work.]

There's a case to be made that too many positions in the military require Senate confirmation.

There's a case to be made that too many positions require Senate confirmation period. There are around 1100 civil service positions that require A&C from the Senate. Combine that with the 650ish flag officers in the US and we are talking about something like 1800 positions that require Senate confirmation.

I think it's time for the Senate re-consider some of it's rules.....or at least put provisions in place to override Senators who abuse their power.
