Hi Kidsagainstkows,
Sorry if some of this is redundant. I am a professing Christian and like some of the others I believe from conception on, the baby is alive and has an inalienable right to life. God gives life and takes it away. So if an individual or a government takes that life, it is a homicide. Basically justifiable homicide is one where a life is taken to protect one or more other lives. So in a case where carrying the baby will result in the death, or a significant risk of death, as determined independently by more than one doctor, then abortion should be authorized. But a mother should not be able to say my mental health is affected because I do not want the baby so abort the baby.
This view is based on my understanding of what the Bible teaches. First, you should not murder which is to say an individual, not acting under the color of government authorization, shall not take a life. Therefore, the mother is violating one of the ten commandments, unless she is actually protecting her life.
Understanding Exodus 21:22-23. What is implied by the word translated "miscarriage?" It simply means she gives birth, regardless of where she is in term. It does not suggest death of the baby. So the line, and no other injury means the baby does not die. Now in verse 23, if either the mother or the child or both die, then the person who struck her loses his life, thus equating a pre-born baby with someone who has been born.
Does the Bible teach that a pre-born babies life is as valuable as someone who has been born? Yes. So I agree with the California law that says if you kill a pregnant woman, and her baby also dies, you are liable for the death penalty because of the "special circumstance" of taking the life of two or more human beings.
