I'd like to see the law change so a person may be declared fit to own a firearm despite previous mental history. For example, if a person hasn't had mental crises in years since a hospitalization, I don't see why they should be prohibited from owning a firearm.

If memory serves, the form only blocks people with a previous mental history for a very narrow set of reasons. You might want to take a look at the form and its instructions to see who is allowed to purchase and who is not (have a look right here). There may be some local restrictions in your state, too.

Here in scenic Arkansas, we don't worry too much about local restrictions -- there aren't many, meaning people typically fill out Form 4473, get the instant background check and the process is done. For those of us with concealed carry permits, the process is even faster.

Thank you, sir, for the information. It turns out I am included under the exceptions for 11f, and it would specifically instruct me to check "no" in answer to the question. Fantastic.

That's going above and beyond -- not that way in my state at all and the feds don't require private sellers to perform checks.

I live in Washington state and the extremely liberal West side of the state passed a law saying all private sales have to go through an FFL.

I sold a pistol to a coworker and we had to go to a dealer and fill out the forms and pay $15. Then the dealer held on to the weapon until the checks went through, which take a week or so out here.

It's pretty inconvenient and I'm sure the drug dealers and other criminals are completely ignoring the law.

I'm waiting for the West side liberals to pass even more strict laws and cause a mass exodus. I'm 2 miles from the Idaho border and have lots of equity in my home. Looking to move over the border to Idaho within a few more years.

We have the same rule where I live, but the transfer happens immediately. It adds onto the cost of the gun and it's inconvenient. I read an article yesterday that says so far it has had no effect on anything, that there are no changes in "gun violence" statistics and that there is only a slight rise in the number of background checks. The article blamed the fact that people are ignoring the law and the police are not enforcing it either.
So far in my state I've read about one case of someone caught breaking it. It was by a very liberal minister who was anti-gun and didn't know about the transfer law. He transfered the gun for it to be destroyed and was found out. Of course since he was anti-gun, it was decided not to prosecute him. If it had been someone pro-gun, it would be a different story.
