Washington Times: Supremes Uphold Sotomayor Opinions at Above-Average Rate | FiveThirtyEightI'd need a chart of cases where SCOTUS took on the case and then overruled the lower courts, and there would need to be quite a majority before I would believe that they only take cases where they're going to overrule the courts.
If you can give me that, great. If not, it's still your opinion.
Clearly they are choosing cases which they are likely to reverse....the Supreme Court typically reverses about 75 percent of circuit court decisions that it chooses to rule upon.
The reason that the reversal rate is so high, of course, is that the Supreme Court has a lot of discretion about which cases it chooses to review and rule upon, and is generally not going to be inclined to overturn law dictated by a lower court unless the legal reasoning is substantially questionable and has a strong chance of reversal.
