No, that wasn't my intent. I was referring to whether the federal government took care of something vs. the state government. For example, Colorado (I think) passed a law legalizing MJ. Now we have a clear example of states rights vs. federal rights. I was however referring more specifically to Obama's preference for federal programs, aka "Obamacare", vs. State run health programs. Obama believes the federal government and a board of 15 doctors should decide what treatments I can get for different medical conditions, and I fundamentally disagree.

Did you even read the story? It was done by a Republican protesting the re-election of Obama. If anything you should be mad at Republicans for disrespecting our flag.

Yes I did, never seen someone do that before though.

Then you do not get out much or read very widely.

Flying the US flag upside down is a signal of distress and many groups take to doing so when they are out of power or feel slighted.

This is an ongoing and always present concept in the US but the Civil War kind of put things in favor of a strong federal government and limits on states rights.

Hence my comment that the South lost. We are not a "confederacy".

Going beyond the statutory interpretation points - including the need for textual, contextual, and purposive reading which would naturally read down the board's powers - there's a simpler argument that kinda destroys the point of the piece.

It's a pretty fundamental part of the common law (and thus, I would hope similar in the US as it is in Canada) that first instance courts are courts of inherent jurisdiction. It's been repeatedly found that just because an authorizing piece of legislation says "decisions of this tribunal/board are not subject to review" doesn't mean it's not subject to review. All administrative action is reviewable. So will this Board's.
