Oops - I goofed again. Yes, the Florida law REQUIRES parental notification, because without it clinics do not have to tell anyone!

It doesn't seem to be a particularly objectionable law: it's got exceptions for medical emergencies and for cases involving abusive parents.

The background:

Florida passed a similiar law nearly a decade ago. The ACLU and others sued. The state supreme court overturned the law on the grounds that a child has a right to privacy which supercedes a parent's right to know.

Last year a constitutional amendment was on the ballot allowing such a law.

It passed 65% to 35%.

That initiative increased turn out which, in large part, resulted in Kerry not having a chance to win Florida and the GOP picking up a Senate seat.

It also did the Democratic party no favors in state races.

I'm about as pro-choice as they come, but with these provisions:

Doctors can perform the abortion if there's a medical emergency, however.

and

The law also lets judges grant waivers based on the patient's best interests, her level of maturity or if she has been a victim of parental abuse.

I can't argue too hard. Good job, Florida -- if you're going to have a notification law, this is the way to do it.

As I understand it, the earlier SCOFL decision to strike the notification law turned on the above justification ringing hollow, cuz kids could have any medical procedure but abortion without telling their folks.

That bill and this amendment weren't passed to give parents a right to know about medical procedures (or else it would've applied to medical procedures generally).

Wha? I thought parents had to be notified about ANY medical procedure? Or does this vary a lot state to state?

i agree that, with the provisions, this is definatley a good thing, and it is nice to see so many of us in agreement for a change.

Having an abortion is an emotionally charged event, and I think people under the age of 18 need all the support they can get, even if it is after the fact. Ya know...
