We are not claiming and have never claimed ownership of material that users upload. The new Terms were clarified to be more consistent with the behavior of the site. That is, if you send a message to another user (or post to their wall, etc...), that content might not be removed by Facebook if you delete your account (but can be deleted by your friend). Furthermore, it is important to note that this license is made subject to the user's privacy settings. So any limitations that a user puts on display of the relevant content (e.g. To specific friends) are respected by Facebook. Also, the license only allows us to use the info "in connection with the Facebook Service or the promotion thereof." Users generally expect and understand this behavior as it has been a common practice for web services since the advent of webmail. For example, if you send a message to a friend on a webmail service, that service will not delete that message from your friend's inbox if you delete your account.
This pretty much sums up how they define "use".

Yep, was reading about it on Consumerist earlier. It's basically the same thing as places like Cafepress.com that say if they ever want to use anything uploaded on their site by you for any reason, they can, and there is nothing you or anyone else can do about it.

In the big scheme of things it shouldn't be that big of deal. Anything you post anywhere online should be done so with the thought that anyone anywhere can and will have access to it. From a systems point of view I can't help but wonder if these new TOS is more of an effort for Facebook to cover some of their liability than it is an effort to really own anything you post.

It's not a matter of having access to it, it's a matter of them being able to use anything you post for their own profit and promotion.

Lets say that your wife put up a picture of herself swimming in the ocean on facebook. Then 3 weeks later you see an ad on facebook of your wife, and beside it says "Sexy singles waiting to meet you". The fact that the TOS says what it does and you continue to use the service gives them the right to use that picture as they please.

I was going to make a similar point.

Posting anything on the Internet is a crapshoot really.
That's why I would never put anything up (not like I have anything!! lol) that could be marketed. I do have some baby pix up there...and I guess I compromised a bit on that one.
