The Constitution. The president must have a pretext that Congress has or would authorize.

What would actually happen in that case, real world, is that the the Pentagon communications system would mysteriously go down while the JCS ran to their Congressional contacts for assurance that Congress was on board.

I personally served through six presidents. Most 4-star generals will serve through about that many, or more. None of them intends to go down for following an illegal order from any particular short-timer in the White House.

Back in the last few days of the Nixon administration, I was on the Strategic Air Command headquarters staff. We got a sub rosa message from Air Staff in the Pentagon not to respond to any "unusual" commands directly from the White House, but to wait for instructions through normal channels.

Rather than simply stating your opinions as fact, please break down what he is reported to have said and demonstrate why, in your opinion, it did not fall within his role (as you understand it - I think we can both agree that the parameters of the highest ranking officer's job are not determined by random people on the internet). That said, if you think that role does not involve taking steps to avoid catastrophic and needless armed conflict, maybe your understanding is too basic to use as a starting point for discussion.

Milley’s position was to act on the directives of the secretary of defence. The policy of Mark Esper at the time was to reduce tensions over the U.S. presence in the South China Sea. Milley, having cleared the call through the proper channels, was acting under this directive. These are things you can easily find out.
