I think the problem is this law that allows the child of an illegal to automatically be a US citizen. If you're here illegally, so is your child, and you both need to be deported.

What about people that are in the US legally? Say, on a vacation. If a woman is pregnant and has the baby on US soil, while legally in the country, why shouldn't that child be a US citizen?

Further, what about kids born to US citizens abroad; should they be denied US citizenship because they weren't born on US soil?

No they shouldn't. What soil you were born on should have nothing to do with it. Why do you want to have it both ways?

technically these children shouldn't be considered citizens by immigration law because their parents were sojourners.

The solution to that is to tighten up the interpretation of : "and subject to the jurisdiction thereof," clause in the 14th Amendment to exclude illegal aliens and others who are here on temporary visas.
