Former Columbia University student Mahmoud Khalil was freed from detention on Friday after a federal judge ordered his release, ruling that the government’s efforts to keep him in custody were highly unusual and potentially a form of punishment for his political views.

Khalil, a legal permanent resident, was arrested in New York in March and flown to an Immigration and Customs Enforcement detention center in Louisiana. In April, his wife gave birth to their first child, Deen.

[Judge] Farbiarz said the government had made no attempt to rebut evidence provided by Khalil's lawyers that he was not a flight risk nor a danger to the public.

"There is at least something to the underlying claim that there is an effort to use the immigration charge here to punish the petitioner," Farbiarz said, referring to Khalil as he ruled from the bench, adding that punishing someone over a civil immigration matter was unconstitutional.



The Trump Administration imprisoned a U.S. resident for expressing his views on Israel. That is not a crime....or is it in Trump's America?

The idea is to deport non-citizens who support enemies of America. We don't want jihadists.

Any foreigner who supports a terrorist organization is a danger to the public. Khalil was directly involved with the crimes at Columbia and supporting terrorism. We have already seen what people will do to Jews in this country who hate them. Thus went far beyond just marching down the sidewalk with a sign, which would have been fine imo.

This involved a take over, trespassing, and hostage situation and physical injury. Khalil was a part of that as a negotiator demanding ransom. Telling the university they had to do something to make it stop. That combined with his ties to terrorists makes him a threat we don't need. He needs to go.

Had he just marched around with a sign, I wouldn't care if he stayed.

Those sound lie really convincing reasons to bypass the constitution. We should deport him because some people find him scary.

The constitution dues not guarantee that any foreigner who comes here gets to stay here no matter what they are involved in. I don't believe the constitution says anything about deportation of foreigners at all. It says very little about immigration and provides no immigration law.

I was speaking of the overall scheme, which included violating our border laws. Certainly the high number of aliens who entered our country legally is included in the scheme. Part of the plan is to waste as much time with the activist judges in order to keep as many in the country as possible.

Good question. The state sure isnt going to being a liberal bastion. But I dont know why the feds haven't gone after him for accountability. Maybe its harder to prove than what they are going after. They most likely feel this is the easiest pathway. Especially when you DONT have to have a criminal conviction in order to remove a visa and deport someone.
