He wasn't making a neurological assessment. He was evaluating whether or not Biden had the "intent" to commit a crime, which is a necessary component of the charges in question.

Again, he's a lawyer, and he was tasked with evaluating the legal case for prosecution.

His conclusion:

"We conclude the evidence is not sufficient to convict, and we decline to recommend prosecution of Mr. Biden for his retention of the classified Afghanistan documents."​
