Hi, I haven't posted here in the divorce board since last year when my husband left. But we tried to patch things up and he cheated and started becoming abusive again.. so in october I filed for divorce. Just got the paperwork for our final hearing. it is February 15th. I'm hoping it will be able to be waived.. but if not I'm not worried. We live in Indiana.. it's a no contest state and everything. I was just curious what happens at the final hearing.. if we go, is that the day it is final? I know different states may be slightly different.. but I'd still like to know regardless of the state how it works.. Just curious what all usually goes on in it.. and how long to expect it to be so I can let my boss know. I'd appreciate any answers you could give me!

It varies on the laws of your state, but here in GA a divorce is considered "final" the day the judge signs all the paperwork. I don't know how your case will work. Do you have an attorney you could consult with? I hope so. If it's uncontested you can find one under $1k to help make sure you are properly covered.As for the day itself-I'd certainly request the whole day off, sometimes you can wait all day for your case to be looked at, and you need that day off (if not more) just to process it all emotionally. Your attorney can file what is called a motion for judgement on the pleading-(this is what I did) where you don't have to appear in court for the hearing and as long as the paperwork is done properly and signed by both parties, the judge can sign without you even having to go to court. I found out at work by calling the courts clerk to see if it was final, and veryfing with my attorney-a few days later I got the decree in the mail. Georgia's is pretty much the same as Virginia's methinks.

Here in Virginia, the divorce is final once the judge signs the final decree. A lot of people like to say that it's truly not final until 30 days after the judge signs the final decree because it can be challenged during that timeframe by the defendant.

But for all intents and purposes, whenever you say what date your divorce was final, it's the date the judge signed the final decree.

That's good that it's uncontested though, mine was as well and it went by pretty smoothly. I would check if you even have to attend the final hearing... I have a feeling you don't have to.

Hi! thanks for your answers! I found out not long after I posted this from my attorney, he just set it to put a deadline on my ex's attorney to get things done..and he said we should not have to have a hearing.. I already requested the whole day off from work.. and i'll probably still take it, so I can get some things done.. cause I'm going back to my maiden name.. not sure how that's gonna all work, if it will be all done.. or if I'll have to go do anything. But I did have it put into the final agreement.
