DEVELOPING STORY:
Beleaguered and disbarred former District Attorney Mike Nifong, who prosecuted the Duke University lacrosse rape case, could wind up in jail if a motion is granted asking that criminal charges be filed against him, FOX News has learned.

The three Duke lacrosse players falsely accused of rape by a stripper plan to file the motion Friday against the ex-Durham County district attorney . . .

well, this isn't good news.
 huh?

I think he went well beyond any reasonable attempt to get a conviction even if they weren't guilty.
Criminal intent included.

He should be disbarred, brought before a judge and
punished to the full extent of the law. I would be up for
equal time to what the rape accused would have gotten, had they not had enough money to defend themselves.

While we'd like to look at this guy and clamor on about what he did, really what he did was try his case in the media and stir up racial issues. While it is despicable, I don't believe what he did was criminal, and I think it would set a bad precedence in the future. The man has been disbarred, will likely be sued, and will lose if he is. I say let him stay free so he can work to pay off the kids whose lives he stole for a year. He wont be able to do that in jail.

He withheld exculpatory evidence. And he did it when he was running for re-election. While I do not know the law, it seems if somone can be charged for giving false information to a law officer, a officer of the court should face criminal penalties for knowingly withholding exculpatory evidence especially when he is using the case to advance his election prospects.

Yup...sure was. Nifong got what he wanted: re-elected.

Fisher Ames, framer of the Constitution and Congressman from the first district of Massachusetts wrote in 1805:

We know from history every democracy is delivered bound hand and foot into the keeping of ambitious demagogues. . .We are sliding down into the mire of a democracy, which pollutes the morals of it's citizens before it swallows up their liberties
