Most people don't know their rights.
But if it was in plain sight, can't the cops search the vehicle as that can be considered probable cause? Or at the very least any evidence obtained in plain view would be admissible, no?
Regardless the entire case is absurd. So even if they thought it was meth residue, does it really take a month to get results from the test? And as you correctly pointed out, being ordered to go to drug counseling is guilty until proven innocent. This woman is due for a decent settlement.
