  • CF has always been a site that welcomes people from different backgrounds and beliefs to participate in discussion and even debate. That is the nature of its ministry. In view of recent events emotions are running very high. We need to remind people of some basic principles in debating on this site. We need to be civil when we express differences in opinion. No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

"The Second Amendment, from the day it was passed, limited the type of people who could own a gun and what type of weapon you could own," Biden said. "You couldn’t buy a cannon."
"During the campaign, Biden made a similar claim about cannons in the Revolutionary War and who could own them. We rated that False.
This time, on top of that, Biden misrepresents what the Second Amendment says."
Biden said that from the start, the Second Amendment "limited the type of people who could own a gun and what type of weapon you could own."
The Second Amendment limited government power, not the rights of individuals. Laws at the time that limited firearm ownership were primarily racist, aimed at controlling Black people and Native Americans.

Biden and Democrats aren't getting the Second Amendment wrong. It was interpreted correctly for over 200 years...
The Supreme Court's Shift On The 2nd Amendment
Well, for really more than about 200 years, the understanding of the Second Amendment was that it gave state militias the right to keep and bear arms but not individuals. That changed in 2008 in the famous decision of District of Columbia v. Heller where Justice Scalia for the court said that, under the Second Amendment, individuals had a right to keep handguns in their residences. That's what that case was really about.

But it really opened the door and raised the question of, what else do individuals have in terms of the right to bear arms? And conservatives and the National Rifle Association have been pressing the court for more than a decade now to expand the Heller decision and make sure that individuals have the right to possess more guns, bigger guns and limit restrictions on any sort of handguns - any kind of guns, not just handguns.

The Supreme Court's Shift On The 2nd Amendment
From your article:
MARTIN: More than a decade ago, the Supreme Court ruled that individuals have the right to bear arms, which is, as you write, a fundamental shift in the court's interpretation of the Second Amendment. Can you explain what happened?

TOOBIN: Well, for really more than about 200 years, the understanding of the Second Amendment was that it gave state militias the right to keep and bear arms but not individuals.

Who exactly held that understanding?......scotus/federal court rulings?.....nope.......federal legislature?......nope.......state legislature?.....nope. That statement is nothing more than liberal hogwash that has been repeated over and over with no proof ever provided until people simply started to believe it.......

Supreme Court rulings for 200 years interpreted the second amendment much more strictly.

Should I trust my studies on this subject; or should I just take you word for it?

Laws at the time that limited firearm ownership were primarily racist

If I recall correctly, every SCOTUS ruling regarding gun laws, up until the Heller case, was racially motivated.
