• Starting today August 7th, 2024, in order to post in the Married Couples, Courting Couples, or Singles forums, you will not be allowed to post if you have your Marital status designated as private. Announcements will be made in the respective forums as well but please note that if yours is currently listed as Private, you will need to submit a ticket in the Support Area to have yours changed.

  • CF has always been a site that welcomes people from different backgrounds and beliefs to participate in discussion and even debate. That is the nature of its ministry. In view of recent events emotions are running very high. We need to remind people of some basic principles in debating on this site. We need to be civil when we express differences in opinion. No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

Doesn't matter, manslaughter is criminal negligence.

Accedents arnt criminal. If your choping wood and someone is with you helping and they walk behind you and you accedently hit them in the head with the axe and it kills them are you guilty of manslaughter.

Did I say it was the same thing?

then why ask that question?

Nevermind I see you figured it out and edited your response.

Murder is defined as the illegal diliberate killing of one person to another. As far as the law goes it is a predetermined act of violence.

I'll provide another example to help flesh out the manslaughter dealie.

Say a woman doesn't know she's pregnant, gets drunk and falls. As a result she miscarries.

Would that be considered manslaughter as well?

No.

Miscarriages aren't concluded within the laws of justice.

But he said it was manslaughter, not murder.

Then why does he title the thread abortion and murder?

And then after he said it was manslaughter, I answered him with,

"No.

Miscarriages aren't concluded within the laws of justice."

The title is misapplied.

It doesn't matter. If the deliberate death of a fetus is considered murder to some people, then should the negligent criminal death of a fetus be considered manslaughter?

The topic makes perfect sense. A person that murders is taking part in a deliberate act, but does that mean that a person that doesn't deliberately take someone's life is not criminally liable? Of course not, many people go to jail for accidental death, and you see it many times when a person is given jail time for vehicular manslaughter.

Now the question here is if people consider abortion to be murder, would the negligent killing of a fetus be considered manslaughter? A person isn't immune from prosecution if they are negligent, so do you think that women that miscarry should be prosecuted if they are negligent?

This, boys and girls, is what is known as a hypothetical.
Manslaughter is a term used only within a court room.

The only way it could possibly be termed that is if it went to court. A miscarriage isn't an incident that is recognized within the walls of a courtroom.

But to take your hypotheitcal approach to it, it is possible.

Not every death of a person by another person, incidental or not, is always recognized as criminal negligence, or manslaughter.

If someone is at the movie theatre watching a scary movie, and comes up on a scene that scares them soo much that they scream at the top of their lungs, causing the person 6 rows in front of them to have a heartache and die, is that manslaughter through criminal negligence?

So the answer to the initail question is a maybe...?!

They might be held accountable, and then again, they might not be.

I think you're having trouble grasping what a hypothetical is.

I didn't say that, and I don't think any of use said that either.

No, because it's not a crime to scream at the top of your lungs in a movie theater.

Shouldn't have been drunk in the first place.
