CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

It doesn't appear that previous rule would have applied in this case anyway. It was fairly narrowly tailored and the train in question didn't meet the requirements for the rule to have been in effect.
Not all of the cars would have been effected by the Obama regulation but many would have. Many of the cars which were burning would have been effected, though the car with hot bearings wouldn't.

The train derailed when the train applied its brakes but which car derailed first isn't known, yet.

Likely not given the regulation. Doesn't really matter anyways. The problem doesn't seem to have been the breaks, but a broken bearing which nobody was alerted of. Why nobody was alerted is still not clear (did the system to detect the fault not work properly? The engineer not notice the alarm? Did the alarm threshold just get crossed at a bad time and the threshold needs to be tighter?)
The NTSB hasn't ruled on which car derailed first. The hot bearings were detected by sensors and the engineer applied the brakes and the train derailed.

I retired from NS RR and was in the track department. They may never know the exact chain of events.
