If you change your appearance so much to look like the opposite sex then you should either go in and get a new driver license or be prepared for a difficult discussion with a police officer. Its a choice you made and you'll have to deal with the consequences of it. Accept the responsibility.

We all should do that. Human nature is not to accept the responsibilities that come with choices we make. We want to blame or avoid far too often. What really makes the difference and allows us to move on is to accept responsibility and make the needed change. Going and getting a new license which matches your transformation is an inconvenience and costs some money. But sometimes thats the small cost if taking responsibility and holding yourself accountable.
The person got a new license. That's what caused her troubles.

Typical "damned if you do, damned if you don't".

As someone who works in retail, and lives in Nebraska, and is exposed to the general public on a daily basis, looks can be VERY deceiving. Most of the time it's very obvious, rarely it's not. Sometimes it's hard to tell.

I agree people should be responsible for the choices they make, and they have no right to "complain" about it.

Not debating BUT:

If it says "sex" then saying "Male" on a "trans woman" ID is accurate, as so I've been told.

It doesn't say "gender" on an ID. UNLESS, the two should be combined.

THEN, we just get into semantics, then.

That's where thinks get rather murky and rather tricky.

You should ask the police. As reported, it wasn't the photo or its likeness to the person that was the issue.

Just curious. Are gender and sex consider interchangeable on ids?

I think this depends on jurisdiction. From my understanding, before the latest law change in Kansas it was ok for the drivers license to display the individual's gender. The latest law change made it into a pure sex marker. A quick googling tells me that most US states still views it as ok for the drivers license to display the individual's gender (https://mapresearch.org/equality-map/identity-document-laws-and-policies/).

In a time with photographic drivers licenses, one could ask why display sex or gender at all. For example, mine doesn't state it but with the information on it it is possible to deduce my legal sex (yes, it is a thing).

Anyone know?

AFAIK, ids only say “sex” and never “gender.”

As described it seems that the officer didn't believe the M marker. She Changed Her ID to Comply with Kansas’ New Anti-Trans Law. Now, the State is Trying to Put Her in Jail for Having an 'Inaccurate' License.

And she was by law obligated to have a M marker.
I see, that's what was confusing me. It appears that this is a consequence of trying to appear as the opposite sex. Everyone knows you cant be. This is an appearance issue. I mean you can change your appearance. There is no law against that, but if you do radically change your appearance you might have some explaining to do. Which in this case he did and the officer let him go. I don't know exactly what happened here. I wonder if the prosecutors got confused as to what happened. Maybe they thought at first he didn't actually get his license changed?

I read the article, but it doesn't exactly give the specifics as to why the prosecutors filed charges. It also doesn't give specifics as to why they dropped the charges either. So we don't really know anything. Not enough info.

It works perfectly well to look like whatever gender one prefer though. This would be a direct example when gender isn't interchangable with sex.

This is not an appearance issue (that would make the "M" an appearance marker), either the cop or the prosecutor made a mistake. I guess you could argue that the legislature messed up as well.
