Attorneys from the firm Romanucci & Blandin said he was held for approximately five hours without being formally charged, allowed to contact his family, or granted access to legal counsel.

The teenager was restrained with zip ties and handcuffs and transported to a federal law enforcement facility not affiliated with CBP or ICE, according to the law firm. They also said his mother was not informed of his whereabouts during the detention.

Family attorneys secured the boy's release yesterday evening. No charges have been filed against the boy, the firm said.

"Among them, a U.S. citizen teenager threw eggs and hit a CBP Officer in the head. Agents observed him gathering rocks after objects had already been thrown at law enforcement officers. The individual was arrested for the assault and taken to the FBI Field Office in Chicago where he freely admitted without questioning to throwing eggs at agents. His attorney met with him at the field office, and he was released without charges."

The 32-year-old man who was detained during the enforcement operation at a Home Depot was a U.S. citizen, according to an immigration lawyer who spoke with his family.

A Department of Homeland Security spokesperson told The Times on Tuesday night that the man allegedly “exited his vehicle wielding a hammer and threw rocks at law enforcement while he had a child in his car.”

Lindsay Toczylowski, co-founder of Immigrant Defenders Law Center, confirmed that the man in the video was the father of the child. She said the firm had reached out to the family thinking that the father would be in immigration custody but then learned that he and his toddler were both U.S. citizens.

[Grandma on seeing the video] “When they got into the car, taking my granddaughter, I said, ‘Why are they taking her, are they really ICE, are they kidnapping her or what?’” Avalos said. “It was really horrible.”

Toczylowski said the family received a call from federal immigration authorities and were told to pick up the child at the federal building in downtown Los Angeles.

At some point the people provoking these incidents should share some of the blame

Call another parent or guardian?
Call local law enforcement?
Call CPS?

Just off the top of my head as a civilian.

As to the claim he threw rocks, I do not find anything put out by this admin credible. They have proved themselves untrustworthy and adroit at making statements which are easily disproved. If he is convicted in a court of law based on evidence I will believe it happened.

Law enforcement deals with these situations all the time. Ask dad whom to call. If there's no family member on hand, CPS -- people trained to deal with children -- get called in.

You don't hop in some stranger's car and take the kid down to the downtown station, 25 miles away.

I'd be willing to believe it happened if there is actual video of him throwing actual rocks. Conviction is a much higher bar.

I have.

Which is why I need to see some video to know why he got out of his car. It frankly doesn't make any sense that someone rolling up to the Home Depot to get some stuff with their child in the car would spontaneously participate in an anti-ICE crowd, particularly if there were others there.

Maegan Ortiz, executive director of Instituto de Educación Popular del Sur de California, said their centers across L.A. County had been raided 14 times before, but this was the first time that agents had entered a center.

She said agents took the chain off the gate of the day laborer center, went inside and threw the site coordinator, a U.S. citizen, on the ground and detained him. She said the coordinator’s wrist was fractured. He was later released an treated at a hospital for the injury, she said.
