My argument is that the Supreme court has an absurd definition of "probable cause".
Then go take it to the Supreme Court, seeing how you feel more qualified than they are. Meanwhile, the vast majority of the United States will rest assured that common sense prevailed.

This isn't about whether something is right or wrong or "common sense" - you claimed that Kavanaugh did not say something. I pointed out where he did, in fact, say the thing.
And I am saying that he did not say any person can be stopped because they are brown and waiting for a bus. I am saying they can be stopped when they are exhibiting what 99.99% illegal immigrants demonstrate. That is called "probable cause."

You do not have to answer any questions of ICE or any law enforcement officers. However, if it is a "Terry stop" and they ask you your name and you don't provide it, citizen or not, they can detain you.
Some states have automatic id laws where if an officer asks for name, date of birth, etc. the person must comply but other states don't. Only if they have "specific and articulable facts" can they stop you.
As you have said, "the Supreme Court overturned that ruling." So I do not give a flip about whatever a liberal activist district judge thinks.
No, the Supreme Court did not overturn that ruling, it merely lifted the stay until a real ruling can be made.

Except he did. Not explicitly, but by overturning the ruling that a person cannot be stopped because they are brown and waiting for a bus, that indicates that, in fact, a person can be stopped because they are brown and waiting for a bus.

What you say can and cannot happen is irrelevant, since - as far as I know - you are neither an ICE agent nor a federal judge.

Baloney. What he said was:

"To be clear, apparent ethnicity alone cannot furnish reasonable suspicion; under this Court’s case law regarding immigration stops, however, it can be a 'relevant factor' when considered along with other salient factors."

One of the other relevant factors was NOT waiting for the bus.

The other factors are:
1. those individuals tend to gather in certain locations to seek daily work;
2. that those individuals often work in certain kinds of jobs, such as day labor, landscaping, agriculture, and construction, that do not require paperwork and are therefore especially attractive to illegal immigrants;
3. and that many of those illegally in the Los Angeles area come from Mexico or Central America and
4. do not speak much English.

So, looking Hispanic is not a reason, waiting for a bus, is not a reason.

If some one is standing outside a bank there is no particularized suspicion to stop them.

If they are outside a bank holding a gun, carrying a face mask and got out of a car with a driver and the car is running, there is reasonable suspicion to stop him. Maybe the gun is legal to have, maybe hes returning the mask to a store down the street, maybe his buddy just drove him because his car is broke down and this was the only place to park.

But if cops are looking for suspicious activity that may be criminal then this is it and provides reasonable suspicion for a stop.

All those things Kavenaugh gave provide reasonable suspicion for a stop.

He didnt say a brown guy walking down the street is reasonable or no did he say if you hear someone speaking Spanish its reasonable. Its about the totality of circumstances.
