No word yet on how far along she was that I have seen, or if the pregnancy was the result of incest or rape. Not a lot of information at all yet, honestly.

If this is true. Which I doubt. This is very inhumane to do to many fetuses. Since many drug addicts have fetuses and don't quit drugs.

In Central America, similar laws are routinely used to victimize women who have miscarriages. It's codified misogyny.

There will be women arrested when they have a natural abortion. Let us hope they are not convicted, but it will very difficult to prove one's innocence in that case.

Just some itchy trigger fingers in Texas. Per WaPo:

When prosecutors charged Herrera, they might have been thinking of a pre-Roe abortion ban that is still on the books in Texas, [University of Texas School of Law professor Steve] Vladeck added, but has not been in effect since 1973 because it is unconstitutional under Roe.

Nine states still have pre-Roe bans, which could come back to life depending on what the Supreme Court decides in June.

“We could see more of this,” Vladeck said.

Woman imprisoned for abortion, wrongfully charged with murder, will be allowed to sue prosecutors, sheriffs for $1M

For the two nights she spent in a Texas jail after being wrongfully charged with murder for a self-induced abortion in 2022, Lizelle Gonzalez, 26, will be permitted to sue prosecutors and sheriffs in a lawsuit seeking $1 million in damages.

Prosecutors tried to have the case thrown out but during a hearing in a Texas courtroom, according to the Associated Press, U.S. District Judge Drew Tipton, an appointee of former President Donald Trump, would not oblige them.

After reaching a settlement with the State Bar of Texas, [DA] Ramirez paid a fine of $1,250 and agreed to have his license in probated suspension for a year.

Texas officials are trying to get a lawsuit dismissed under qualified immunity after wrongly charging a woman with murder for having an abortion.

The officials attempted to have the case against them dismissed in a July, 2024 filing, citing qualified immunity. The statute makes state and local officials immune to lawsuits over their conduct in the line of duty unless they violate "clearly established statutory or constitutional rights."

A new filing on behalf of Lizelle Gonzalez by the American Civil Liberties Union disputes Starr County officials' claim of qualified immunity, maintaining that District Attorney Gocha Allen Ramirez, Assistant District Attorney Alexandria Barrera, and Sheriff Rene Fuentes "knowingly and maliciously abusing their power to concoct charges and violate a person’s constitutional rights."

"Texas law is clear: a pregnant person cannot be arrested and prosecuted for getting an abortion. No one is above the law, including officials entrusted with enforcing it.”

Totally agree. Just like the emergency provision this is clear. They screwed up. It was a wrongful arrest.
