Why clearing homeless camps is harder in California than most states. Will Supreme Court make it easier?

But thanks to a series of rulings by the 9th Circuit Court of Appeals, public officials in California and eight other Western states face greater scrutiny and legal challenges when they move to clear encampments or relocate homeless people — even when the local laws are virtually the same as those used by cities outside the 9th Circuit.
Yes.

Divided Supreme Court rules in major homelessness case that outdoor sleeping bans are OK

WASHINGTON (AP) — The Supreme Court cleared the way for cities to enforce bans on homeless people sleeping outside in public places on Friday, overturning a California appeals court ruling that found such laws amount to cruel and unusual punishment when shelter space is lacking.

In Fort Worth Tx it’s illegal for homeless people to stand on the corner holding a sign and accepting donations. Personally I think it’s a cruel and incompassionate law passed by people who don’t care if these people who are in need die. Sure some of them are going to buy drugs with the money, but even these people need to eat to survive and what about the people who don’t spend it on drugs. They take away the only source of food they have.

Anti-panhandling laws weren't devised to punish the needy. They're meant to protect customers and the neighborhood. Oftentimes they station themselves near businesses or intersections with lots of foot traffic. What follows is a mixed bag. Some are quiet and unassuming. Others are theatrical or a nuisance.

We had one in the area with a penchant for Bill Winters. You'd hear him before he came into sight in the morning. I didn't see him on weekdays. He saved it for weekends instead. Hearing What You Won't Do for Love at 9 a.m. is bad enough. Experiencing the same in front of Saks is too much.

Making the act illegal means they must spend taxpayer money to round them up, process them into the jail then provide a lawyer...feed them too. The state has already demonstrated that is is easier just to round them up and ship them to more liberal areas of the country.

But no other federal appellate court has followed the 9th Circuit’s legal reasoning and now the decisions are being challenged in the Supreme Court, which could take up the issue early next year.

Gov. Gavin Newsom issues executive order for removal of homeless encampments in California

California Gov. Gavin Newsom, buoyed by a recent US Supreme Court decision, issued an executive order Thursday calling on state officials to begin taking down homeless encampments.

The move to begin dismantling thousands of encampments throughout California comes after the high court ruled last month in favor of an Oregon city that ticketed homeless people for sleeping outside.

“This decision removes the legal ambiguities that have tied the hands of local officials for years and limited their ability to deliver on common-sense measures to protect the safety and well-being of our communities,” Newsom added.

The case was the most significant appeal involving unhoused Americans to reach the Supreme Court in decades.
