I wouldn't try to make legal case based on canons. The ruling bishop has the power of economia, which he can apply as he see fit. Definitely worthwhile to ask - but should be done with humility. Even bishops who supposedly have standing rules about no divorce have made exceptions in cases similar to your friend - abandonment or infidelity. There are even cases of widowed priests remarrying. These cases are often contentious, so it's important to remember that peace is important too.

Oh I know he wouldn't try to argue. I'm just hoping the existence of a canon is enough that he might ask. He wouldn't have gone that far otherwise.
