I would be surprised if he doesn't try. The only thing I can see keeping him from attempting it are health issues.

I don't think he would be re-elected if he tries in 2028. It takes a few years for people to forget how a President Trump is, and in general US citizens tend to elect a democratic president to clean up after the recessions caused by republican governments. The earliest I could see him elected for a third term is 2032, which of course would make him 86.

I don't see a path for him to be able to succeed in an action that is so clearly forbidden in the Constitution. He can make speeches and hold rallies all he wants, whatever. But at some point, people have to print his name on ballots, lots of people, and then swear him into office afterwards, even though the Constitution clearly states that he cannot hold the office. I don't see that many election officials going along with it.

The only path I can imagine is if the Constitution were to be amended to repeal the 22nd amendment. That's a possible legal thing. But amending the Constitution typically takes a long time, and it requires more than a simple majority: 2/3 vote in Congress and ratification by 3/4 of the states. I don't see that happening on this question in the next 3 years.

There's only a couple of pathways...both are unlikely.

1) the existing amendment would have to be repealed via another one. Which requires 2/3 of both houses to agree on an amendment, and then ratification via 3/4 of the states. Unless there's a red wave of epic proportions in both the federal and state levels (in a lot of states), that one's got a snowball's chance in hell.

2) A crazy hypothetical. (and maybe there's already another rule that squashes it). The verbiage says "nobody can be elected to the office of president more than twice". In 2028, he and JD Vance switch spots on the ticket so he's only "Running for VP", and then after all the swearing in is done, Vance voluntarily resigns, and the succession plan kicks in.

That's not the important question here. The question is whether the person in office will peacefully leave office when their term is up. Rule of law is a vitally important principle in the US, and the question is whether the people in office have to follow the law.

The 12th Amendment is probably a barrier to that. "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."

I thought that was his best chance, not changing the Constitution, but somehow finding a way to evade counting as a person. A Supreme Court precedent declaring him a "man" and distinguishing the two somehow.

Please everyone remember, CF rules do not allow denigrating public figures. He is a human being.
