The Supreme Court [via Gorsuch] on Monday turned down a request from a former Colorado county clerk to halt her upcoming trial on charges stemming from her alleged involvement in an apparent security breach at the county’s election offices in 2021.

The former clerk has pleaded not guilty to 10 state charges, including several felony counts, stemming from the apparent security breach in Mesa County’s elections office in May 2021.

“I definitely think it will be after Nov. 5,” Austin Blessing-Nelson, associate counsel for the Michigan Attorney Grievance Commission, said Wednesday in a pre-hearing for DePerno, who is seeking a Republican nomination for the state’s highest court.

The commission filed a complaint against DePerno more than a year ago — in June 2023 — accusing him of three counts of professional misconduct dating back to his time as an attorney for former state Rep. Todd Courser, who resigned after attempting to cover up an extramarital affair.

[Prosecutor] Drake argued Peters was “fixated” on a desire to be a “hero” and to impress [MyPillow Mike] Lindell, one of the most notable election-denying conspiracy theorists.

“The defendant was a fox guarding the henhouse. It was her job to protect the election equipment, and she turned on it and used her power for her own advantage,” Drake said in arguments, according to The Associated Press.

Per Axios, she faces as much as 22 years in prison.

Tina Peters, the former clerk of Mesa County, was found guilty of four felonies after a lengthy criminal trial. She was cleared of three lesser charges.
Per Axios, she faces as much as 22 years in prison.

Former Mesa County Clerk Tina Peters was sentenced to 8-and-a-half years in prison and additional time to be served in the Mesa County Detention Center for a total of nine years incarceration on Thursday.

Peters was immediately taken into custody and escorted to the Mesa County Detention Center where she will begin serving her sentence. She has 21 days to appeal her sentence.

The case marked the first prosecution of a local election official over a suspected security breach in connection with the 2020 election.

At the time, Colorado Attorney General Phil Weiser called her conviction a warning that tampering with voting processes will bring consequences.
