There have been a few people who pled guilty to seditious conspiracy for the Jan 6 event. So it has been proven in court that insurrection was happening. I guess it's just whether D Trump was in on it or not.

A court can’t make that decision without a trial.
If this case is allowed to stand someone can bring a lawsuit in Texas alleging that Biden is ineligible because he committed high crimes by taking a bribe. The Texas Supreme Court could then decide without a trial that Biden took a bribe and is ineligible and remove him from the ballot.
This decision is going to be overturned by the SCOTUS based on the free speech issue and due process.

Does taking a bribe make a person inelligible for the ballot?
I thought the 14th ammendment was about sedition.

After the Civil War, plenty of people were held to be ineligible for election to congress despite having never received any conviction of insurrection.

We shouldn't mischaracterize Democrats as being against democracy. What happened here is that on January 6th according to a pre-conceived plan, Trump and some fellow Republican party actors tried to make void the votes of a majority of all Americans who had fairly elected Biden to replace Trump.

How can a court decide someone is guilty of insurrection without a trial?

There was a five day trial in Colorado.... to determine if Trump "engaged in insurrection ...."
Based on the evidence presented, the judge determined he had.

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

- The district court did not abuse its discretion in admitting portions of Congress’s January 6 Report into evidence at trial.
• The district court did not err in concluding that the events at the U.S. Capitol on January 6, 2021, constituted an “insurrection.”
• The district court did not err in concluding that President Trump “engaged in” that insurrection through his personal actions.
• President Trump’s speech inciting the crowd that breached the U.S. Capitol on January 6, 2021, was not protected by the First Amendment.

Matter of opinion. How is Trump any worse than Biden?
The trial was about Trump's actions with the intent of trying to stop the certification of the election he had lost. I don't know of any other President who tried to do that.

and speaking of Democrats, I like how they removed the other candidates off the primary ballot in Florida. This effectively canceled the Florida primary and awarded the electoral votes to Biden uncontested.

I would’ve suggested that we try to trick the VP into authorizing the votes of some fake electors, but that’s been done.
