I recall during the original discussions regarding the possibility of letting trans people choose the restrooms of their preferences that many people who were opposed to the idea cited the likely "ramifications" of such legislation being rape and sexual assault.

The snide response from those in favor of such lunacy was "there's no evidence of trans people raping or sexually assaulting anyone in restrooms" which was mostly true....but obviously, it was only true because trans people had to use the restrooms that biology dictated, like the rest of us.

So the childish and snide response to any possible future ramifications of this legislation would be to point out that there's no evidence of those ramifications.

I'm not going to say that though....I'm genuinely curious about what sort of downside to this legislation people think exists.

This sounds like bad news for a friend of mine. Her genitals were "misformed" at birth and, despite actually being female (including a vagina, ovaries, etc), the fact she had something resembling a penis at birth she was "identified" as male initially. I guess she would be smart to avoid Nebraska in the future, where it would now be a crime for her to use women's restrooms and changing rooms.

It would be a crime for her to use the men's restrooms from the sound of it.

Frankly, that's appropriate. We tend to have less stalls and toilets than the women's restrooms in general. She's undoubtedly taking advantage of the fewer resources we men have if she were to use the men's room.

And before someone asks, her birth certificate was corrected

Well one can't actually change one's biological sex.

Although it does seem clear now the whole idea of "gender" has been used as a stand in for biological sex so that this particular group of activists can make their ludicrous demands.

I don't see it being an issue if they are that passable.

If everyone in the women's restroom thinks the person is a woman....or everyone in the men's restrooms thinks the person is a man....it seems unlikely the police will be called.

If there is someone in there that sort of looks like a woman; but sort of looks like a man too, especially if he has a bulge and a beard; and he is standing around loitering, watching women come and go; I would say that deserves a call to the police.
I have had what I thought were men (did not perform a genital check) come into the women's restroom 3 or so times in my life to use the facilities while I was in there. I felt no need to call the police on someone who needed to urinate while not in public.

I've never seen a restroom that had multiple stalls, with exterior doors that lead directly to each individual stall.
Well, most of the people I've seen, wait until they get into the stall and close the door before exposing anything. But things may be different where you live.

A few years ago, at a concert, the women's restrooms were overcrowded and a woman in desperation went into a men's restroom. The guys realized her predicament, and formed a sort of protective line to make sure she had her privacy. Well done, guys.

Exceptions do not disprove the rule. Public policy can be created for the common situation and adjusted as necessary for bona fide exceptions.

But here, now: Weren't we told that there is a difference between sex and gender, and sex was indeed biological but gender was a social construct? Wasn't that the position of trans activists not long ago?

Has that changed? Have they conflated sex and gender today, and are they claiming both are social constructs?

Why, yes....they are:


It occurred to me that this was one of the inevitable goals of trans-activists once they managed to get their condition removed from the DSM.

It's now replaced by "gender dysphoria" which is a dubious condition that causes stress in a person who society recognizes as male or female against their personal desires.

It's quite possibly the most bizarre entry into the DSM.....ever. We generally recognize someone as suffering a mental illness when their perception of reality is so far removed from that of the average person or rest of society that it causes them some significant impairment. "Gender dysphoria" however, suggests that the person suffers no such impaired perception.....but rather, the whole of society is impaired.

I think to make any real headway on trans issues....we need to go back to the older definition the DSM had for people suffering such problems.

Men don't gratuitously expose ourselves even in the men's restroom. That would weird. We turn toward the urinal, unzip, then zip back up (or at least be tucked back in) before we turn away from the urinal.

We don't even look at each other in the men's room. That would be weird.

We don't even strike up conversations with strangers while standing at the urinals. That would be weird.

We don't open conversations with strangers while holding our business in our hands. That would be weird.

I remember a guy in high school who would always make the same joke at the urinals....

"I hear this is where all the Richards hang out."

Well, yeah. I guess people go through becoming transgender just to get access to women's toilets. It's the obvious thing to do.

Or access to women's prisons, or women's showers, or women's sports teams.



Is this meant to be a serious position? I think it is, because satire doesn't seem to be your style.

Well people have testified before Congress regarding it. Some might call that evidence of seriousness.

I would suggest that the left's hyperfocus on race and gender however is nothing more than a smokescreen to draw attention away from real problems like the endless warmongering, inflation, rampant crime, abysmal education, healthcare, and the 9 million illegals pouring into the country along with all the problems they bring.

It seems that some want the restrooms to be a free for all, where any man can say, "oh I feel like a woman today; I think I'll spend some private time with the girls."

About 20 years ago, my dad and I accidentally used a lady's restroom at a movie theatre because the door was wide open and we thought it was unisex. Thankfully, no women were in there doing their business. It happens.

(I have no clue why on earth I remember that).

If/when enough transgender men get arrested while using the women's restroom, have the charges dropped, and then win their wrongful imprisonment lawsuits against the state, the law may change. Money talks after all.

I don't see that happening. Biden altered a Constitutional amendment by executive order.....which is not how one goes about altering an amendment.

Should someone attempt to enforce this change through a criminal or civil suit....my guess is this administration will dismiss the suit, and not allow it to proceed.

If it were allowed to proceed, inevitably a higher court will end up rescinding the executive order. That would be pretty embarrassing for this administration.


They would of course have to survive the arrest and subsequent imprisonment to bring the suit.

Your concern for women is commendable. Do you have similar concerns for transgender people? Because 1% of over 27,700 transgender individuals surveyed in 2015 (that would be 277 people) reported being sexually assaulted in public restrooms just in that year. A further 1% were physically assaulted, and 12% were verbally harassed.


A more recent 2019 study shows that over 25% of transgender teens are sexually assaulted every year. That percentage rises to 36% for those whose schools deny them access to their preferred restrooms (this compares to 15% of cisgender girls and 4% of cisgender boys who report being sexually assaulted). To be fair, not all of these assaults necessarily occurred in bathrooms.


It seems to me that transgender people are more at risk for being assaulted when using the bathroom that corresponds to the gender they were assigned at birth than women are at risk from being assaulted by transgender people using the women's bathroom.
