And why would it? It's just one element of the 1st degree crime. Did they list all of the other elements in the indictment?

Trump was informed what he was charged with (1st degree false business records x34) and what specific acts of falsity each charge associated with. There doesn't seem to be a 6th Am. leg to stand on here. Like with the SOL issues, it will be litigated in pre-trial motions. If the judge rules there isn't a sufficient intended other crime, it will be tossed or lowered to 2nd degree. This is the same as any "SOL issues" which could get the charge tossed.
Where I live SOL means something completely different

Trump does seem to have hired a couple good NY white collar criminal attorneys just before the case opened.

Oh, wait, you were talking about our fellow posters. I get it. I also find their lack of faith disturbing.

If there is anything we can be certain of, it is that Trump will *insist* that every motion (including frivolous ones) will be filed. On the charges, the venue, the SOL, the indictment, the bias of the GJ, everything. They will so much pasta at the wall it will be like a violent temper tantrum at a Fazzoli's.
Do you blame him? I would do the same.

So you are unaware that Bragg reduces real felonies to misdemeanors? That is unless your name is Trump then he does the reverse.
Yes I am, which is why I was asking what you were talking about. When did he do that?

"Mr. Trump, who pleaded not guilty to all charges on Tuesday, is the 30th defendant to be indicted on false records charges by Mr. Bragg since he took office just over a year ago."

He seems to be consistent with these kind of cases no matter what the last name.

The crimes are not required to be included in the indictment, but they have been made known.

In a news conference held after Trump's appearance in court on Tuesday afternoon, Bragg clarified what prosecutors view as two possible other crimes in the Trump case.

The first is New York state election law, "which makes it a crime to conspire to promote a candidacy by unlawful means," Bragg said. In this case, that "could include" false statements, like the misrepresentation to tax authorities of the payments to Cohen.

The second is federal election law, which caps the amount that can be donated to candidates in federal elections.

The indictment does not specify these other crimes. Bragg said he views New York state law as not requiring prosecutors to do so.

The third is tax evasion. Apparently lawyer's fees and bribery are treated differently under tax law. Because it's NY tax, it doesn't have the potential problems of including Federal election law.

The defense is going to have no problem with this case
Yes. I'm certain the NY prosecutor who prosecutes many of these types of cases will not be prepared for his case against one of the most powerful men in the world who is known to be vindictive to an extreme. I doubt he would have compiled compelling evidence to present while the eyes of the world are on him. It will be a slam dunk against him.

The prosecution won’t have to have a slam dunk. The chances of Trump getting a fair trial in NY are very slim. But he will have grounds to appeal

Why not? Trump despite his scattershot business record is a longtime successful developer and New Yorker. He himself will tell you he is adored in NY. Just because New Yorker's voted for someone else for president other than him, doesn't mean he won't get a fair trial.

I also doubt "Grounds to appeal" will be a hard hurdle for Trumps lawyers. It is not a slam dunk for either side. We will see what the prosecution can mount. This case is not going to be cut short by simple technicalities.

Hasn't he represented Trump on a couple of occasions? Maybe take with a grain of salt.
He is a liberal and said he would be voting against Trump for the third time if he is nominated.

She had an illegal server with classified information on it and when the records were requested she had her staff destroy the records.
That isn't true. She did have a private server and she did get classified emails which she oughtn't to have. However, she cooperated with the FBI and gave them copies of the server before destroying it. :!!: Hillary:!!:

This is very clearly prosecutorial misconduct. We have had enough. These endless charges against Trump to try and stop the people from voting for him is an attack against our Republic.
Endless? This is the first one in a criminal court.

Great. He also thought Trump didn't do anything wrong while Trump et al conspired to steal election.
