If he wants to go around the Supreme Court he should go to Congress and have the law changed. That whole thing is ridiculous. When all sides to a lawsuit agree it should come as no surprise when a group of judges also agree.

SCOTUS said one clause of one law didn't allow EPA to do X.

An EO, or some other clause of some other law may allow X or maybe the original law allows Y, which is not too different from X. There's nothing particularly devious about this.
