Wis. Democrats file first-of-its-kind suit vs. fake Trump electors

Three Democratic voters in Wisconsin, including two who served as electors for President Biden in 2020, filed suit Tuesday against 10 supporters of Donald Trump in the state, arguing the group engaged in a civil conspiracy to violate state and federal law when they declared themselves presidential electors in 2020 even though Biden won the state’s popular vote.

Wisconsin was one of five states won by Biden where Republican electors gathered Dec. 14, 2020, and declared themselves “duly elected and qualified” — then sent signed certificates to Washington purporting to affirm Trump as the actual victor of their states. [The two other states sent notes making it clear the new electors were only qualified if the vote was officially overturned in some fashion.]

The lawsuit filed in Wisconsin’s Dane County represents a new approach to seeking to hold fake Trump electors accountable. It asks that a judge formally declare that the Trump supporters’ actions were unlawful — that they took actions that constituted a “public nuisance” under Wisconsin law, engaging in a conspiracy that violated the rights of Biden electors and voters.

It also asks that the judge require the Trump supporters to take the unusual step of correcting the historical record by sending a judicial order declaring their actions unlawful to the same government entities to which they sent certificates in 2020, including the president of the U.S. Senate and the National Archives. It also asks a judge to prohibit the defendants from ever serving as presidential electors again and require that they pay monetary damages.

Trump campaign officials, led by Rudy Giuliani, oversaw efforts in December 2020 to put forward illegitimate electors from seven states that Trump lost, according to three sources with direct knowledge of the scheme.

The sources said members of former President Donald Trump's campaign team were far more involved than previously known in the plan, a core tenet of the broader plot to overturn President Joe Biden's victory when Congress counted the electoral votes on January 6.

Giuliani and his allies coordinated the nuts-and-bolts of the process on a state-by-state level, the sources told CNN. One source said there were multiple planning calls between Trump campaign officials and GOP state operatives, and that Giuliani participated in at least one call. The source also said the Trump campaign lined up supporters to fill elector slots, secured meeting rooms in statehouses for the fake electors to meet on December 14, 2020, and circulated drafts of fake certificates that were ultimately sent to the National Archives.

"We fought to seat the electors. The Trump campaign asked us to do that," Meshawn Maddock, co-chair of the Michigan Republican Party, said at a public event last week that was organized by the conservative group Stand Up Michigan, according to a recording obtained by CNN.

“I must ask for your complete discretion in this process,” wrote Robert Sinners, the campaign’s election operations director for Georgia, the day before the 16 Republicans gathered at the Georgia Capitol to sign certificates declaring themselves duly elected. “Your duties are imperative to ensure the end result — a win in Georgia for President Trump — but will be hampered unless we have complete secrecy and discretion.”

The admonishments suggest that those who carried out the fake elector plan were concerned that, had the gathering become public before Republicans could follow through on casting their votes, the effort could have been disrupted. Georgia law requires that electors fulfill their duties at the State Capitol.

In a statement, Sinners said he was working at the direction of senior campaign officials and Georgia Republican Party Chairman David Shafer, who served as a Trump elector in the state. “I was advised by attorneys that this was necessary in order to preserve the pending legal challenge,” he said.

A New York Times report details a batch of new emails related to the fake-elector plot. Figuring prominently is a Phoenix-based lawyer who worked with the Trump campaign, Jack Wilenchik.

“We would just be sending in ‘fake’ electoral votes to Pence so that ‘someone’ in Congress can make an objection when they start counting votes, and start arguing that the ‘fake’ votes should be counted,” Wilenchik wrote to Epshteyn. He summarized a proposal by Trump-allied lawyer Kenneth Chesebro as designating the fake electors “so that members of Congress can fight about whether they should be counted on January 6th.”

Wilenchik said in another Dec. 8 email that Ward wanted “to keep it under wraps until Congress counts the vote Jan. 6th (so we can try to ‘surprise’ the Dems and media with it) — I tend to agree with her.”

It’s also very difficult to square with the fake-elector plot being characterized as merely a contingency.
