They can fire you for working sick and fire you for staying home. Sounds like a lose-lose situation for the employees.
Pretty much in at will employment states they can fire you for ANYTHING that is not in the civil rights act as a protected class.

I go in for an interview if they will not give me the benefits I want I turn down their job offer. If I am otherwise a good employee and have the skills they need/want and they want me badly enough they will bend.
Have you ever been in a situation where you needed a job and were not in a position to be picky? It’s not realistic for most workers to go around turning down otherwise good job offers. Employers know this. They hold the power.

Welcome to the wonderful world of powerful unions and collective bargaining, without which the employers will just hire people who don't demand sick leave as part of the package instead of those who do. Unequal power in labor is why these regulations need to exist in the first place.

If it effects interstate commerce it does, and since viruses don't care for state lines, I think it does.

Do you really think paid sick leave stops a virus from crossing state lines?

Isn't always available.

In my line of work, industrial construction, I have no access to paid time off of any kind, would not be allowed to take extended sick leave in most cases without being fired for not being at work and due to the temporary nature of my jobs have not been eligible for any FMLA benefits in nearly ten years.

I am aware of that as are most employees. That is why they will overlook common sense, hide their illness, and go to work anyway. Common sense does not pay the bills.

Have you ever been in a situation where you needed a job and were not in a position to be picky? It’s not realistic for most workers to go around turning down otherwise good job offers. Employers know this. They hold the power.
It is also not wise for employers ( in most businesses to have a high turnover rate as people look at that and say why do people leave so quickly a such it works best to treat your employees well.

The family Medical Leave Act is not paid leave it is merely job protected leave.

If the Law was enacted for this time of Coronavirus would it automatically be lifted when the threat is gone or the Panic was not as great as it is now?

Do you think someone who is living paycheck to paycheck and doesn't have paid sick leave is going to stay home when they are sick? If you think they should stay home, even if it means that they might get evicted... well, that is pretty monstrous, but fine. You can think that if you want.

The question here isn't what they should do, but what they will do. In reality, nobody who is so utterly dependent upon their income that they cannot afford to miss a day of work, much less two weeks because of a mandatory quarantine, is going to stay home when they are sick. They are going to spread things, whether you think they should or not.

This means that not providing mandatory paid leave during an emergency like this not only harms those who come down with serious enough cases of the illness that they lose two weeks of wages, but it makes it impossible to contain the virus, since anyone in an economically precarious situation who is healthy enough to work even though they might have coronavirus will be working. And they will spread it.

I guess they would be fired then. It doesn’t solve the employees problem of not being able afford unpaid days off.
