Open Letter to Senate Judiciary Committee from Yale Law Faculty

In an open letter to the Senate Judiciary Committee, 50 faculty members of Yale Law School asked the members to give the FBI time to investigate a sexual assault allegation made against Supreme Court nominee Judge Brett Kavanaugh. The letter urged the Senate to conduct a “fair and deliberate confirmation process.” Faculty members expressed their concern that a rushed hearing would threaten the integrity of the confirmation process and the public’s faith in the Supreme Court. Given that a position on the Supreme Court is a lifetime appointment, the faculty members argued that a “partisan hearing alone cannot be the forum to determine the truth” of the allegation against Kavanaugh. Instead of relying on a committee hearing, faculty members urged the FBI to be given the time necessary to investigate the facts.

“Fair process requires evidence from all parties with direct knowledge and consultation of experts when evaluating such evidence,” the letter stated. “In subsequent hearings, all of those who testify, and particularly women testifying about sexual assault, must be treated with respect.”

Well I have a feeling that the folks who teach at Yale Law School have a better understanding of the law than most internet forum posters.

Well I have a feeling that the folks who teach at Yale Law School have a better understanding of the law than most internet forum posters.

At the very least it's ironic that the "elite" have a better understanding than Christians who post on this forum about the necessity of having trust in our institutions and avoiding the appearance of evil.

What does his honesty (or lack thereof) have to do with what I said? I just pointed out that sexual assault doesn't exactly fall under federal jurisdiction.

There should be a statute of limitations for this sort of thing. It was not a rape if there was no penetration. I do not think an investigation at this late date will turn up much. Some people have difficulty remembering correctly what happened two weeks ago, much less 36 years ago. In Florida the statute of limitations for sexual battery (penetration) is eight years. If it is not reported in eight years, there is no prosecution. Misdemeanor battery (striking a person) has a statute of limitations of one year.

Well seeing as how an appointment to the SCOTUS is lifetime it makes perfect sense that there be an investigation into allegations of misconduct in his lifetime. If the allegations are true then it's not just a wrongdoing from 36 years back, it's a wrongdoing right now since it would mean he was lying about it. It has to do with his judgement, which sure as heck is relevant seeing as how his judgement would have an impact on this country for generations to come. It's in his best interest, hers, everybody that the allegations be investigated properly.

It was not a rape
She does not accuse him of rape or even attempted rape. She accuses him of sexual assault. The question is when a women climbs into bed with a man, what consent does that imply.

Although none of that matters because Kavanaugh did not do the crime. I believe there was a crime. I believe she was assaulted. But I do not believe that Kavanaugh was the person that did it. Not is their any evidence to suggest that he would do anything like that.

First of all you would have to show that he was there at that house on the night that she claims she was assaulted. If she can not come up with a witness to show that he was there at that party, then she really does not have much of anything at all in the way of evidence that they knew each other at all.

All he has to do is say: I do not know that girl. I never met her in my life.

Clearly she climbed into that bed with someone and clearly that someone was not Kavanaugh. She wants to stop the appointment, so I am sure she is willing to lie and say Kavanaugh was the person that assaulted her when clearly he is not that person. I wonder who is paying her and how much to make these allegations. She can't provide any substantive evidence that any encounter between them actually occurred. I wouldn't be surprised if she was bribed with an attractive financial consideration to make the allegation.

I would have been if they had investigated back when they received her letter on July 30 2018. This is Sept 22 2018. They waited until right before the vote to release this information. They should have done all of this 6 weeks ago. Also her letter says: CONFIDENTIAL. So why did Senator Dianne Feinstein violate her confidential letter to turn this into a three ring circus? Maybe Senator Dianne Feinstein does not take the letter serious because she admits she has no way of knowing if Ford is telling the truth or not.

Water over the dam. The fact remains the FBI has not done any investigation of these claims. Anita Hill's claims were investigated in three days by the FBI. There's no reason the committee can't pause for a few days while the FBI investigates.

Feinstein might should have acted faster, but she was in a pickle. Understandably, Dr. Ford wanted to stay confidential, most likely on account of having correctly predicted that coming forward would mean the exact sort of harassment & threats she & her family are getting right now. The content of the letter wasn't kept totally confidential, just her name. Feinstein didn't leak it. One of Kavanaugh's buddies began looking into Dr. Ford before her name was made public. Dr. Ford sent an email about that with a timestamp showing it was sent before her identity was publicly revealed. It was publicly revealed when she spoke out about the allegations publicly.
