Kentucky gov's lawyers say Kim Davis should have to pay gay couples' legal fees
Attorneys for Kentucky Gov. Matt Bevin (R) say in a court filing that former Rowan County Clerk Kim Davis should be held responsible for legal fees incurred by same-sex couples who sued her for denying them marriage licenses.

The Lexington Herald-Leader reported Wednesday that while Bevin has publicly supported Davis and lauded her as "an inspiration," his attorneys said in a court brief that the former clerk "stood in direct conflict" with the law.

The governor's lawyers argue that the Rowan County Clerk's office, not the state of Kentucky, should be stuck with the nearly $225,000 in court costs accrued in lawsuits against Davis.

They are the ones who initiated the lawsuit. Kim should not have to pay the legal fees for their lawsuit, whether she was found to have been in the wrong or not.
You should tell that to the Governor of Kentucky, it's his position that since it was her office was the one that:
... A district judge ruled in 2017 that the couples suing for marriage licenses clearly prevailed and that the state of Kentucky must pay their fees and costs.

Bevin appealed that ruling, hoping to hand the bill instead to the Rowan County clerk’s office. Davis acted alone, without any state support, the governor’s lawyers told the 6th Circuit in briefs ahead of the oral arguments.

“Her local policy stood in direct conflict with her statutory obligation to issue marriage licenses to qualified Kentucky couples. The local policy also undermined the Commonwealth of Kentucky’s interest in upholding the rule of law,” Bevin attorney Palmer G. Vance II wrote in one brief.

I just feel that in any lawsuit, the plaintiff should front the cost.
That'd be a really effective way to eliminate lawsuits by those with little means.

If she had been doing her job, there would have been no lawsuits. She works for a secular gov't that doesn't legislate morality. She was acting in her own interests rather than the interests of the state. So, I think this is fair.
