Unfair McTreatment

Years back most of you may recall a lady who won millions and millions from McDonalds when she spilled a cup of coffee in her lap from McDonalds after having gone through the drive through.

This poor woman was scorned publically and ridiculed in the media.

This was all unfair. This elderly woman had to have several skin grafts due to the burns on her lap.

The judgment and award was made fairly by a jury that took into account that the punitive damages given the lady were a mere fraction of what McDonalds makes just on coffee sales. In spite of that, the judge lowered the awarded amount.

The real crime commited in this case was McDonalds cruel and unusual personal assault against the defendant in waging a publicity war against her.

I was thinking about this while eating an Egg McMuffin this moring and thought I would share.

I don't remember ANY scorn for the poor woman's injuries, which were regrettable and with which EVERYONE sympathized.

The scorn was a reaction to the absurd notions that McDonalds was at fault for the fact that SHE spilled a hot drink on HERSELF, and that, because McDonalds has a large revenue stream, the company should foot the bill for her own carelessness.

The scorn was a reaction to the absurd notions that McDonalds was at fault for the fact that SHE spilled a hot drink on HERSELF, and that, because McDonalds has a large revenue stream, the company should foot the bill for her own carelessness.

Frankly if I had been the judge I would have made a bigger example of McDonald's. I think it's very, very disappointing how easily it was turned round into a P.R. victory for McDonald's. When corperations are that wealthy and powerful, we should be making darn sure that they HAVE to put customer care and staff care at the absolute top of their agenda, and I think that making sure they feel pain on cases like this is one of the ways to do that.

Anyone who doesn't know coffee is HOT shouln't be drinking it. And did she put the cup between her legs, or was that another case?
When corperations are that wealthy and powerful, we should be making darn sure that they HAVE to put customer care and staff care at the absolute top of their agenda, and I think that making sure they feel pain on cases like this is one of the ways to do that.
I get tired of these cases where it is "for her own carelessness" as chilehed stated.

This is the same liberal attitude that wants to blame fast food establishments for fat kids, the tobacco companies for people smoking, gun manufacturers for murders, and all this other nonsense that is going on.

Why can't people accept responsibility for their own actions instead of blaming big corporations for their problems? Maybe because then the Democratic party wouldn't have their "victims" to help which making sure everyone is a victim is the only way Democrats can get into power.

I agree with you.

This reminds me of the poor old man who was ordered by a judge to pay dammages (I forget the amount) to a young man who had tried to buglarise his home,,, and was attacked and injured by the home owner's guard dog.

Skin grafts for an elderly lady would require cream etc for you or I. It's about the frailty of the skin not the temperature of the coffee.

I have no great love for McDonalds as a company, far from it, but I do have great issues with the entire compensation culture that is so pervasive in our society today.

As someone has already said here, we must take responsibility for our actions, and accept that accidents do happen. I have great sympathy for this poor lady, as we all do, but it was an accident, pure and simple

Yes, she did. Same case. And she did it while driving.

I worked for McDonald's Corp. for 7 years. I think maybe they should have helped with medical bills, but then they would have opened the door for any lunatic that wanted a free ride, so they said no. But the judgment was a joke.

Coffee is hot, so don't spill it on your lap. Cars move fast, so don't step in front of one or drive them into trees. Knives are sharp, so don't pick them up by the blade.

The ideal temperature for brewing coffe is between 180-200 degrees F; I just measured the water coming out of my coffee maker at 150F. Water at 150F casues severe burns in 2 seconds, at 140F it takes only 6 seconds.

The fact is that this lady exercised extremely poor judgement in what she did. If that cup of coffee had come out of her own cofee maker at home she would have still been badly burned, so she had no cause to claim that she couldn't know that she would get burned by the coffee at McDonalds. She was entirely at fault, and no amount of hackneyed class-envy rhetoric will change that. Reasonable customer care extends to polite service, product quality, and competitive pricing; it does not require protecting one's customers from their own stupidity.
