The news story says that it was the last day of class when he handed in his textbook, two students testified that he told them he did it intentionally, and the teacher testified the young man made no attempt to avoid vomiting on him. The Court had the opportunity to evaluate the credibility of all the witnesses. So it seems there's sufficient evidence to support finding he did it intentionally, which would be battery (intentional, offensive contact).

Is it a cruel and unusual punishment? It didn't say he would be prohibited from wearing rubber gloves or a respiratory mask, so it doesn't seem calculated to cause him any physical harm. Community service, in general, is common. And, hospital and nursing home staff clean up vomit every day. So, it seems reasonable to conclude that it was not cruel and unusual punishment.
