Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

Norma McCorvey, the “Jane Roe” in the infamous Supreme Court “Roe vs Wade” decision legalizing abortion, along with her attorney, has announced that she will be petitioning the Supreme Court tomorrow (actually later today) at 11:00 a.m. to reverse Roe vs Wade. I think its success a long-shot, but worth praying for.

I don't think so, Jeff. I know she's spoken out publicly before, but nothing like this, filing a motion with the Supreme Court, I don't think . . . though I could be wrong. But even if I am wrong, and she has tried this before, let's just hope and pray that the Court decides to grant a hearing to rule on this petition. It's pretty difficult just to get the Court to even grant hearings on petitions. Especially on issues and specific cases they've already ruled on.

She do this before, I think it was 2 years ago and the court actually said something to he effect that we have had it legal for so long we may as well keep it legal. I can’t remember exactly but the way I took it, it would have been opening too big a can of worms reversing it so they just rather leave it alone.

No she hasn't, Michelle. Not at this level; not at the Supreme Court level. This is the first time McCorvey has actually made it back to the Supreme Court of the United States.

She had to go through the process, first filing a motion at the federal district court level. After that was denied, she then had to go further through the federal court system, to the appellate level, which brought her "one step closer" to the Supreme Court, like the link says. After that was denied, which it was, only then could she approach the Supreme Court again, which she is doing now . . . for the first time.

What you are referring to must be the denial of the motion at the appellate level, which was in 2003.

Yes, pretty sure. That is the process (and that's what the linked articles indicate). A petitioner cannot go directly to the Suprem Court without first exhausting all avenues in the lower levels of the federal court system, except in rare instances where no other court has jurisdiction, like in the 2000 presidential elections, for example, where it went directly to the United States Suprem Court.

What standing does she have to do this ? Norma herself was quite secondary to this case ( as is the case in all supereme court decisions). What basis does she have to petition the court directly ?

She was the Roe in Roe-v-Wade. It is her right as the person named in the suit to repetition to court. No one but her can do it in fact.
