Bejeweled is actually a blatant rip-off of a Sega game called "Swirl" (which can be downloaded and played for free on shockwave players).

Unfortunately, gameplay cannot be copyrighted, only game graphics, music, story and other such contributions.

While this legal loophole has allowed the game industry to grow and has not posed many problems, it does pose a great problem for the puzzle game genre since the art, music and generally non-existant story of those games can be easily replaced.

I'm not sure how the owners of Tetris got around this... perhaps the distinct shape of the 7 Tetris peices is considered art.

I never saw "Swirl". Bejeweled has been around for a while.

I don't think it's unfortunate that gameplay cannot be copyrighted; a good puzzle game can make money anyway, and *ideas* for puzzles are a dime a dozen.
