Sounds like the judge pretty much had no choice but to release him.

In the state of New Mexico, someone hitting you with a skateboard would constitute reason for self-defense. ...and they claim that he allegedly assaulted 3 women, yet they can't find them and they haven't come forward as of yet. So the DA dropped the shooting charge.

However, it sounds like he's still going to be on the hook for carrying his firearm without a permit so he's had his firearms removed, and he's not allowed to attend any protests.

If someone's hitting you with a skateboard and you shoot in self-defense, and the entire reason given for the skateboard use was that he was assaulting 3 women. They would need to come forward.

The DA can't pursue those charges, and the judge can't issue an order to hold someone (with no previous record) for an alleged assault with no witnesses if the DA isn't in a position to file those charges.


Obviously the guy was an idiot if he showed up just to antagonize protesters. However, no matter what kind of actions a person engages in, there are still constitutional rights and processes that have to be adhered to.

Meaning, a person has a right to a speedy trial, and the right not to be held indefinitely with no charges filed.

Even if you have a strong suspicion someone is in the wrong, you can't hold them indefinitely with no charges and no concrete evidence while the DA goes on a fishing expedition trying to track down 3 nameless people to get their statement on record.

I did read the article. He was released but still has charges pending.
